ATHENS, Alabama -- An Athens man convicted of rape still won't serve jail time despite controversy around his original sentence and an ordered resentencing by the Alabama Court of Criminal Appeals.
In a ruling handed down today, Limestone County Circuit Judge Jimmy Woodroof sentenced Austin Smith Clem to time served in jail and five years of probation.
Clem, 25, was convicted of raping his neighbor when she was 14 and again at 18.
In the resentencing, Woodroof resentenced Clem to 15 years for one count of first-degree and 10 years for each of the two counts of second-degree rape, but those sentences would only be in effect if he violates his probation. He was convicted back in September on those charges.
