Supreme Court justices question size of buffer zones around Mass. abortion clinics
Source: Washington Post
Justice Antonin Scalia said lawyers for Massachusetts were distorting the debate.
I object to you calling these people protesters, Scalia told Miller, saying it was a case about counseling and comforting women, not protesting abortion.

(809 posts)If the religious zealots are really "counseling and comforting," women, why do they need to be kept 30 feet away?
Tony's theory of jurisprudence is, "Shit I think."

and, for the record, what about the RIGHT of the women to peacefully obtain a LEGAL medical procedure???? what about THEIR right to free speech, and freedom of assembly???
tony is nothing but a shill for an outdated, extreme woman-hating organization, which he demonstrates every single time he opens his mouth.

(40,366 posts)don't people usually get counselling as a matter of their own volition?
Without consent, I think it could be also called harassment.
King_Klonopin
(1,306 posts)To begin with: if one is berating, shaming, and harassing people -- total strangers he/she knows nothing about --
how does that even come close to meeting Webster's definition of "Counseling" ? Standing on a public sidewalk
does not give one license to intrude into another person's PRIVATE affairs.
Secondly, to characterize what these political protesters/terrorists are doing (and that is what they are) as
"helpful", in any way, is shamefully dishonest. Scalia knows this is an intellectual insult, but he gets off on it.
But mostly, to your point: Scaley can call it whatever he wants -- he can call it the Hokey Pokey, for all I care --
but, if this "discourse" is not mutually entered into with the consent of both parties, how the fuck can that be
construed in any way as "counseling", or even a conversation ? It causes more harm than good. For example,
if a recovering alcoholic stood outside a barroom and shouted at people going in that they were all irresponsible,
drunken bums, believing his intentions were good, how would this be received? Would that behavior be considered
"counseling" or harassment (or crazy)?
Scalia is an offensive, right-wing, authoritarian, fascist bully of the biggest proportions. His signature trademark
is offering absurd, logically-twisted arguments that justify the oppressive ideology of his and his fellow bully cohorts.
In this case, he is simply trying to manufacture legal protection for those who are engaging in public harassment --
the type of behavior that should elicit anger... and a restraining order. Scaley is an affront to the term "Justice".
To prove my point, I think that I will stand in front of my dentist's office and hound the people who come to have
a tooth filled or pulled. I can accuse them of being selfish and irresponsible because they obviously don't brush their
teeth properly, like I do ... and I'll say I'm offering "dental counseling" -- just before the police haul me away for
trespassing and creating a disturbance.

(2,205 posts)GREEN BAY - A U.S. Supreme Court Justice was in Green Bay Thursday night. Justice Antonin Scalia has served on the nation's highest court for 24 years. Thursday, he made a special appearance, as a new lawyer's group made its debut. Justice Scalia has spoken at Marquette University in the past, but rarely, if ever, makes a public trip to our area. Catholic Mass at St. Francis Xavier Cathedral is a fairly common occurrence. However Thursday night's Mass, while traditional in many ways, also hosted a few guests of honor. Among them, ranking members of the Catholic Church in Wisconsin, and U.S. Supreme Court Justice Antonin Scalia.
"I would say he's a lawyer at the top of his game," said Deacon Paul Umentum of the Green Bay Catholic Diocese. Umentum is also president of the St. Thomas More Society.
We invited him over a year ago and we were surprised to have him say yes, but he did and it is a big deal," said Umentum.
Bishop David Ricken of the Diocese of Green Bay went to Rome in 2005, where Justice Scalia's son was in seminary there. That is how Ricken came to know Scalia, and organizers tell us that personal relationship played a role in his appearance Thursday night. Before the Mass, Scalia spent some of the day duck hunting.

(1,989 posts)how far would I get if I wanted to give Scalia some counseling on when it's proper to recuse himself and when it isn't? [cf. Bush vs. Gore]. How close could I get to him before Supreme Court Security Guards were to haul me away? Why is "speaking to" someone a fundamental right when it's someone seeking an abortion, but not a fundamental right when it's a Supreme Court Justice?

(22,000 posts)People have the right to free speech, but people also have the right not to be harassed or bullied. Putting the buffer in place was the only thing possible to assure both could happen at the same time. If they overturn it and do away with the buffer there is nothing from stopping the protesters from banging on windows and doors.
