ACLU: Newark stop-and-frisk targets black residents more than others

Despite comprising just more than half of Newarks population, African Americans make up 75 percent of the stops under the city Police Departments stop-and frisk-program, a report released today by the American Civil Liberties Union of New Jersey has found.

"Several disturbing patterns have emerged that raise constitutional red flags about the Newark Police Departments stop-and-frisk practices," Udi Ofer, executive director of the ACLU of New Jersey and co-author of the report, said in a statement. "Specifically, our report raises concerns about the high volume of stops, racial disparities in who is getting stopped and the fact that the vast majority of stops appear to be of innocent people."
The report, which studied data from July to December 2013, found that 25 percent of those stopped in Newark were arrested or issued a summons, meaning 75 percent were deemed not to have done anything wrong.
Most of those stopped 75 percent were African American, who make up 52 percent of the citys population, the report said. Of the rest, 23 percent were listed as white or Hispanic and 2 percent were listed as "other." One of the recommendations contained in the report was that police provide more details surrounding the ethnicity of those stopped.

(24 posts)But to measure the number of stops based on the general population is off the mark. Stops should be based on reasonable suspicion, not probable cause. If a cop has probable cause he makes an arrest. Reasonable suspicion can be something as simple as somepne sites a cop, turns his back, and then makes a movement to his waist band as if he is adjusting a gun. It could be a dozen other things he might be doing, but a good cop would get his butt out of the car and check it out.
As far as measuring the people who get stopped you have to look at the number of complaints. When some one gets victimized he calls 911 and says something bad happened to me and the person who did it looked like this. Far more often than not, in Newark, it is a balck male or hispanic. I don't have the numbers, but if anyone feels differently please show me how I'm wrong.
The ACLU is a fine organization but they are off the mark on this one.This is not how you measure accurately cops breaking the law.
