European court rules against Poland over secret CIA jail

Source: Reuters

The CIA ran a secret jail on Polish soil, the European Court of Human Rights ruled on Thursday, a decision that puts pressure on the United States and its allies to reveal the truth about the global programme for detaining al Qaeda suspects.

The United States has acknowledged the existence of its "extraordinary rendition" scheme in the years after the Sept. 11, 2001 attacks but has never revealed which of its allies hosted the secret detention facilities.

It is becoming harder to maintain that silence, especially after Thursday's ruling by the Strasbourg-based court, which comes as a U.S. Senate committee prepares to publish parts of a critical classified report about extraordinary rendition.

Amrit Singh, a lawyer with the Open Society Justice Initiative who acted for one of the men who brought the case, said the court's ruling established beyond reasonable doubt that Poland-hosted a secret jail run by the U.S. government.

I guess a few ones I know - who have told me that US had no such places in Poland - or who was indeed happy about it - because the ones who was there was clearly guilty of anything they was accused of - because US was not putting people into "black sites" just for the fun of it..

On the other side - I guess some old school expert from the old regime in Poland got some exercises - the secret polish police was rather known for their brutality and their will to use force against inmates who is deemed a problem... specially political enemies of the State..

Court: Poland violated human rights in CIA case
By VANESSA GERA, Associated Press | July 24, 2014 | Updated: July 24, 2014 2:02pm

WARSAW, Poland (AP) — Europe's top human rights court ruled Thursday that Poland violated the rights of two terror suspects by allowing the CIA to secretly imprison them on Polish soil from 2002-2003 and facilitating the conditions under which they were subjected to torture.

The ruling by the European Court of Human Rights marked the first time any court has passed judgment on the so-called "renditions program" that U.S. President George W. Bush launched after the terror attacks of Sept. 11, 2001.

Even though the rendition program has been abolished, lawyers for the suspects believe that the U.S. and other governments continue to operate in too much secrecy, using national security as a pretext for intrusive surveillance and other practices which violate individual liberties. They welcomed the ruling, hoping it will encourage limits on that kind of secrecy.

"Governments still engage in abusive practices and try to hide the facts," said Amrit Singh, a lawyer at the Open Society Justice Initiative who represented al-Nashiri before the European court. "The broad message from today's ruling is to end the impunity of national governments."
