Ginsburg: U.S. Supreme Court won’t ‘duck’ same-sex marriage issue

WASHINGTON Justice Ruth Bader Ginsburg says the Supreme Court wont duck the issue of same-sex marriage the next time a case comes to the court.
The 81-year-old Ginsburg said in an interview with The Associated Press on Thursday that she expects a same-sex marriage case to be heard and decided by June 2016, and possibly a year earlier.
She said attitudes have changed swiftly in favor of the right of same-sex couples to marry, which is now legal in 19 states and the District of Columbia.

(3,145 posts)6-3 in favor with Kennedy and Roberts on the majority BUT Robert's concurrence will be based on an extremely narrow point. Also the decision may very well contain wording that conservative states can interpret as allowing "conscience laws" like the ones permitting business owners to refuse to do business with gays.

(2,345 posts)I am extremely uncomfortable with the SCOTUS, as presently composed, taking on this issue squarely. We can count on Alito, Roberts, Scalia, and Thomas to find some reason why gay marriages can be banned consistent with the Constitution. Being four votes down right out of the gate is not an ideal posture from which to be arguing to the Court.
