Judges blast Ind., Wis. gay marriage bans

Source: USA Today

CHICAGO (AP) — Federal appeals judges bristled Tuesday at arguments defending gay marriage bans in Indiana and Wisconsin, with one Republican appointee comparing them to now-defunct laws that once outlawed weddings between blacks and whites.

As the legal skirmish over same-sex marriage shifted to the three-judge panel of the 7th U.S. Circuit Court of Appeals in Chicago, more than 200 people lined up hoping to get a spot in the hearing room.

Attorneys general in both states are trying to reinstate bans that were ruled unconstitutional in June. The outcome of the case also could directly affect hundreds of couples who were married after federal judges overturned the bans but before their rulings were put on hold pending appeal...

..."It was tradition to not allow blacks and whites to marry — a tradition that got swept away," Posner said. Prohibition of same-sex marriage, he said, is "a tradition of hate … and savage discrimination."....

Authoritarianism isn't party specific. The issues are.

I've pretty much had it with these people trying to demonize whatever it is that THEY don't like, whatever side they're on.

Jefferson warned us a few centuries ago to beware of making laws 'for the good of the people'.

It seems that's all congress can do, as long as someone gets rich from it.

good things, but now only $$$$$ counts. Jefferson warned of a two party system and corporations, but now that seems to be embraced, even to the extent of something as absurd as Citizens United. Way back the country had a goal of working for the benefit of each other, it sure wasn't perfect, but it seemed a goal. Now, many work only for their own tribe and the hell with the rest, a sad state of affair for a supposed democracy.

Health-Care Fears Loom Large in Gay Marriage Cases
INDIANAPOLIS — Aug 25, 2014, 5:59 PM ET
By RICK CALLAHAN Associated Press

When Niki Quasney felt a piercing pain in her ribcage in March, the oncologist treating her advanced ovarian cancer told her to get to an emergency room immediately.

But instead of making the short drive to a hospital near her home in Munster, Indiana, she drove alone for more than 40 minutes to one in neighboring Illinois. Quasney said she was "terrified" her local hospital might not allow her and her partner of more than 13 years, whom she wed last year in another state, to be together if she suffered a health emergency.

Quasney and her partner, Amy Sandler, are among dozens of couples challenging Indiana's and Wisconsin's gay marriage bans in a case being heard Tuesday in the 7th U.S. Circuit Court of Appeals in Chicago. Looming large in the case is the issue of medical emergencies faced by same-sex couples.

Crowds of supporters attended rallies in both states Monday and boarded Chicago-bound buses to support the plaintiffs, who are suing for the right to marry or to have their out-of-state marriages recognized. They argue that powers of attorney and domestic partner registries don't guarantee they'll be allowed to make critical end-of-life or life-saving decisions....

8. Judge Richard Posner... he is the premier jurist of our time, in my opinion.

I'd love to see him on the Supreme Court (plus he was appointed by a Republican President which would make it more likely to get through the Senate).
