Gay Nebraskan with terminal cancer wants family cared for after her death

LINCOLN — Sally Waters wants to make sure her family is taken care of when she’s gone.

She wants to know that they can remain in their comfortable Millard-area home. That they won’t be bankrupted with bills and taxes.

And that her impending death from advanced breast cancer won’t cost her children the chance for a bright future.

But the Nebraska Constitution makes it more difficult because Sally Waters’ spouse is a woman, Susan Waters.

I posted this in LBN because this goes into the US Court system today.

Aren't these family values? From the story: As a result, when Sally Waters dies, Susan Waters will have to pay several times the amount of taxes, won’t get the financial advantages of being a surviving spouse and won’t get Social Security to help take care of the couple’s children.

Millions of people suffer because of their apparent reluctance to end this nonsense in an expedient manner.

to avoid the dreadful scenario, they should immediately create a living trust and transfer all assets into the trust so there will be virtually no taxes and clear inheritance no matter what the court ruling.

Gambling on the courts when one has terminal cancer is risky business.

the legal fees can be a burden to a family who are trying to take care of someone with serious health issues. The cost of that alone can bankrupt a family. They should not have to see an attorney to make take care of this issue. This is why I have so many issues with states rights.

States Rights to me is similar to Family Values and has eroded to often mean similar.

to set up a trust. A good financial advisor will do this work for you. We dealt with this in our family. All of the trust work was done by the financial professional and a local lawyer can be hired (and should - you need someone local and familiar with probate in your area) to probate the estate. It is not that complicated. Both the financial professional and attorney will bill you for your time but it shouldn't be substantial.

the majority would support this woman. People will vote against gay marriage in the abstract but in real life situation they'd support her.
