Houston, we have a problem.

Police in Houston have charged a 10-year-old girl with aggravated sexual assault after she was allegedly spotted playing a game of "doctor" with a 4-year-old boy near her house.

The report from Houston's Fox News affiliate says that they're referring to the 10-year-old girl as "Ashley" in order to protect her identity due to the seriousness of the charges.

Back in April, Ashley -- who was 9 at the time -- was playing doctor in the courtyard of her apartment with a group of other children. Ashley was reportedly inappropriately touching the child.

Two months later Ashley was arrested and charged. She spent four days in the Harris County Juvenile Detention Center.

Quanell X, who has been working with the family, says "I've never dealt with a child this young being accused of a crime. In fact this was nothing more than inappropriate horseplay that has now lead[led] to a child that is ten years old being charged with aggravated rape."

"Ashley's Mother also says the Houston Police sex crimes investigator didn't allow her to sit in on the questioning of her daughter. She says a 45 minute long interrogation that left her 10 year old in tears.

A spokesperson for HPD says they're not commenting on the case because it involves a juvenile....

Meanwhile, Ashley and her mother could not talk about the facts of the case - it's clear they're claiming the young girl did nothing wrong. A girl who has to be consoled by her mother when she talks about being held in juvenile custody those four days.

Ashley says, "when my Mom came to see me I said I wanted to go home and then she said I couldn't go home and she was like I know you want to go home."

Ashley is expected to be in court in October on the sexual assault charges.

But criminal court is not the place for this type of situation to play itself out. It calls for counciling and discussions of appropriate and inappropriate touch. Kids that young don't think in a mature sexual manner at all. And who knows how many younger kids she's been around where she's helped changed a diaper and wouldn't think anything about a game of "Dr" with other kids in the play group? Kids emulate adult positions - like cops and robbers, Dr, cooking, cleaning, chashiering.

It would be nice if we lived in a world where no children were sexually abusing other children. Too bad we don't live in that world.
