Edited Version of FBI Video of Joint FBI and OSP Operation 01/26/2016 (tarpman's shooting)

Last edited Thu Jan 28, 2016, 10:58 PM - Edit history (1)

It is an edited version of the longer one. They drive for a couple minutes, then cut the 3+ min they sit still, then drive again. About 6 min mark is where tarpman drives into the snowbank, gets out of his car. He raises his hands, then reaches for his waist several times and is shot.

It is from a distance, but is clear enough to see him move his arms and drop onto the snow.

ETA "Bretzing said Finicum had a loaded 9 mm semi-automatic handgun in that pocket."

He lowered his arms and was fuckin' around with his coat, looks like to me. I don't blame the officer for saying, "I'm going home to my wife today." If he kept his arms up, he'd be alive.

he was reaching for a pocket in his jacket. A 9 mm was found in that pocket.

I don't like that he was shot, and I agree that he didn't look like much of a threat from the aerial footage. I wish he'd been winged instead of killed. But my guess - and it's only that, a guess - is that the FBI officers were ordering him to get on his knees. That's generally what happens in situations like this. Suspects - especially those suspected of being armed or otherwise dangerous - are immobilized as much as possible before they're arrested. Instead, he reached for a pocket. He was known to keep handguns on his person and had already declared his unwillingness to be arrested. He also came damn close to running over one of the agents as he drove into the snow. So as tragic as this was, I can understand how it may have happened.

A video released by the FBI on Thursday evening appears to show Robert "LaVoy" Finicum reaching for a pocket that police say contained a 9 mm semi-automatic handgun.

But it looked to me like he tried to run into the forest and when an agent popped up there he didn't know what to do, then he decided he was NOT going to jail, and reached for his pocket, knowing what the results would be. They knew he was armed before shooting.

I can understand wanting to die rather than go to jail...especially at his age. I would prefer death to jail myself.

And now it sounds like the four remaining at the refuge have chosen that path too. I can't help but wonder why people choose to die like this, unless it's because they can't face the prospect of going to jail. I think going to jail would be hell for anyone.

35. I just watched the film on oregon live again

this time is was an edited down clip, so shorter, but closer in and in slow mo. If you watch carefully, Finicum runs toward the forest until he sees an agent with a gun, then he turns with his arms up, back toward the truck...then he fumbles around with his arms down (for what purpose we don't know), and then turns back toward the agent in the forest who shoots him.

Consider this. The agent in the forest knows he's armed, and sees him fumbling for something with his arms down from behind, but can't see what he's actually doing, because he's only seeing him from the back. Then Finicum turns back toward him, without raising his arms in surrender, so he is probably assuming Finicum has armed himself and is turning to shoot him. Finicum does not have his arms raised in surrender at that point. I can't blame the agent for this.

I don't think Finicum found his gun or whatever he was reaching for...but I really can't blame the agent.

Then he doesn't follow LEO instructions.

Then he reaches into his jacket...

...BAD MOVE, when they already clearly know it's you LaVoy (3 minutes watching you sit in your truck a few miles back), know you're armed, know you've made threats of using your gun, then you bolt off at a high rate of speed, cross into oncoming lanes, you're driving so out of control and recklessly. Stupid ass!

Is it any wonder he's dead? Not to me.

He was standing behind the black pickup truck for cover, and it looked like the white truck was going to run right into it at full speed. So, he got out from behind it so he wouldn't get run over. Then the white truck turned at the last minute. *Shrug*
