Last Week Tonight with John Oliver: Debt Buyers

Last night on Last Week, CEO of CARP John Oliver gave away more assets in the last few seconds of his show than Oprah did when she gave every studio audience member an automobile. It's shameful but true and uplifting. Thanks again John for pointing out the irony that any malicious idiot can collect debt, even debt which is beyond statute or has already been discharged in bankruptcy.

Since 2010, Bill Clinton brought in just short of $16.5 million for his role as honorary chancellor of Laureate Education, a for-profit college company. He left the position earlier this year weeks after his wife launched her campaign.

For exposing this. Zombie debt collectors survive on "consumer ignorance". If you or anyone you know is experiencing this, you need to research your legal rights...how to respond to these predators. What you say and/or do can cause YOU harm. Start your defense by googling the name of the debt collector and open the links. You will find many good sights that highlight the illegal practices of these goons, they nasty tactics and how consumers have dealt with them. Know your rights and learn to recognize illegal tactics. All these tactics are DESIGNED to ENTRAP you so that YOU/THE ACTIONS YOU TAKE, LEGITIMIZES a debt and give the zombie debt collector a legal claim. A zombie debt collector has NO LEGAL claim to debts they purchase, debt that was sold off/closed by the bank or creditor. They (zombie debt collectors) purchase DATA, NOTHING MORE. They use the data to harass you. Where, when, why these debts come alive again rely on the consumer and that is what zombie collectors are TRAINED to accomplish. Trick/trap consumers into ADMITTING this debt exists (or existed). Even IF this is something you paid off, it was old, beyond the statute of limitation, by admitting it existed YOU are now stuck having to prove that to the zombie and they have NO INCENTIVE to believe you and because you admitted that the debt existed, they now have a right to harass you about it. ITS A LEGAL SHAKE DOWN. The goal is to get you to pay out and they will take it as far as small claims court. The one chink in their amour is that in court, THEY have to PROVE to the court that they had a legitimate claim to the debt as either 1) they are the ORIGINAL debtor or 2) they are ACTING as a legal representative of the original debtor who has AUTHORIZED THEM to collect the debt. Purchasing debt records is NOT recognizes as a legal claim in COURT. However zombie debt collectors are HOPING YOU DON'T KNOW THAT, and that YOU will simply ignore a summons to small claims court. If you fail to show, the zombie debt collector wins by default if though the claim is not legal but YOU didn't show up and therefore the Zombies didn't have to prove ANYTHING. My sister experienced this. A zombie filed a suit in small claims court, and my sister did show up for her case. There were several other defendants in the courtroom that day. Each meeting a few minutes before their case with the zombie's lawyer (a trick) trying to reach a settlement (any money). When my sister met with the lawyer and the lawyer started with "well, how are we going to settle this out of court, my sister demanded proof of the debt. The zombie lawyer got very angry and told my sister she didn't have to show her any proof (a LIE). My sister told the lawyer fine, nothing more to be said, lets proceed in court. When they returned to the courtroom, the lawyer handed the clerk a piece of paper. When my sisters case was called before the judge, the clerk handed the judge that piece of paper and the judge announce to my sister..."I see you forced a PUNT, plaintive withdrew they lawsuit, you case is dismiss. The judge seemed pleased by this. Of course the zombie attorney had to withdraw. They had no legal claim against my sister. No paper evidence. They were not the ORIGINAL creditor, nor were they authorized to collect on behalf of the original creditor. The debt in question was beyond the legal time limit to collect. Zombie debt collector will still push to court on the promise that MOST consumers are ignorant and will either not show up or will settle prior to the case being presented. It is well worth the risk of losing a few cases. Zombie debt collectors rely on ignorance. .
