Writing a new law requires Congressional action. A law prof like Obama would know that. His tenure in office has almost certainly expanded his belief in the limits of executive power (the job does that to all presidents), but I don't think he's gotten to point of rejecting Separation of Powers.

Likewise, separation of powers, due process, and the Bill of Rights are probably also confusing to him.
