They can subpoena whom they like.

If the targets want to claim the 5th, they can do that too.

Mueller-these witnesses are his. IMHO

“It was a counterintelligence investigation before now. It seems to me now to be considered a criminal investigation,” he said after a meeting with Deputy Attorney General Rod Rosenstein.

“What does that mean for the Congress? I find it hard to subpoena records of somebody like Flynn who may be subject to a criminal investigation because he has a right not to incriminate himself,” Graham added. “As to Comey, the former director of the FBI coming before the committee, if I were Mueller I would jealously guard the witness pool.”

Rosenstein gave the impression that recently-appointed special counsel Robert Mueller was treating the investigation as a criminal matter, Graham explained...................

What did the Republicans in the Senate really do? They've been working on this for months. What have they done? Get testimony from Yates? Sessions? Even though Sessions lied under oath, did they MOVE on that? No. They excused his lie, but impeached Bill Clinton for lying under oath about something far less important: having sex with Lewinsky. Sessions lied about meetings with Russians while he was working with the Trump campaign, for gosh sakes.

The Republicans are protecting their own. As Paul Ryan said, "We are a family." (I'm paraphrasing.)

Left to their own devices the Republican Senate would have stalled until the inevitable Trump-created crisis, and then it would have withered and died on the vine. You know, like the Republican controlled House has been doing since this all began.
