The biggest takeaway from this week’s 1/6 testimony from Cassidy Hutchinson: Donald Trump knew the crowd at his rally was armed, encouraged them to go to the Capitol anyway and wanted to join them himself. Legal experts, both Democrats and Republicans alike, say there’s enough evidence to charge the former president with a crime — but it’s unclear if the DOJ agrees. That’s why Trump’s ‘lock up’ Hillary Clinton rhetoric was so reprehensible, anti-democratic, and wrong.

To do so would likewise be a danger to our democracy – we’re not Russia, for example, where Putin falsely jails his political opposition.

It would also establish a dangerous precedent, whereby President Biden could be subject to meritless criminal prosecution by the next Republican president.

Moreover, there’s the concern that if an ex-president were to be subject to criminal prosecution, it could hamstring the current president from making difficult decisions with regard to national security, such as preventing a terrorist attack against America by killing a US citizen in a foreign country responsible for initiating the attack.

I don’t necessarily agree with the above, but these are nonetheless issues Justice must consider.
