Apartment maintenance came by to look at my bathroom ceiling that needs fixing, but he wasn't wearing a mask. So at the door, I asked him if he had been fully vaccinated, and he said, "I don't feel comfortable answering that." So I told him he would have to leave, and he said "I don't need a vaccination" as he went. I called the office and no one has called me back. I don't expect any help from them in this. ( I am fully vaccinated, but with the variant, and considering my health and age ...)
I called the Health Dept., and since Beshears rescinded his executive order about masks, unless you are in a nursing home or some such place, they can't make someone, it is no longer the law.
The people who own the property are out of state, and no one can find a phone number. I know this because there were several comments on there page that people don't know how to get in touch with them.
Any suggestions for recourse?
UPDATE: A different maintenance person, wearing a mask, came by to fix it. I put my mask on, too. Thanks for all your comments and support.

If there is a possibility of asbestos I would look at different options.

(56,358 posts)... if they refuse or don't reply, after the repair, go to small claims court. It's easy and you will get repaid.
A letter from a physician would be a good thing to have, a copy of which you sent with the letter.
Small claims courts provide more justice for we "little people" and doesn't require a lawyer, and is over in fifteen to twenty minutes.

Are you getting help with rent from a social service? Check in with them. Do you have a renter's protection office in either your city or county? They specialize in just this kind of situation. Costs nothing.
I have lung issues, too. If there is a mold issue here, it could be enough to put you into another unit at least. Or at least to report to code official with the city and the county.
We have to be gadflies in the course of protecting our own lives, let alone our living conditions. Squeeky wheels get oil.
Added. It also might be simple as having someone you trust be there while they work.

(4,429 posts)If you are wearing a good mask, that should eliminate your risk (open your windows, too).
I don't know your state or your rights in your state to require him to mask up. But from a risk perspective, if you wear a mask that should provide really excellent coverage.
