(20,176 posts)He hired Jeffrey Kessler, the guy that has basically kicked the NFL's ass every time they've stepped foot in a courtroom in the last two decades.
The National Football League Players Association hired gun has a history of success when facing off against the league in the courts. Most recently, Kessler was behind the efforts that successfully overturned former Baltimore Ravens running back Ray Rices indefinite suspension, and he was instrumental in getting Minnesota Vikings running back Adrian Peterson reinstated.
The high-profile Kessler also represented the NFLPA in challenging and successfully ending the 2011 NFL lockout, and was a key figure in forcing the dismissal of the New Orleans Saints Bountygate penalties by successfully arguing that NFL commissioner Roger Goodells punishment was excessive.

(36,814 posts)The NFL also gets to select the panel that makes the decision. So it's pretty hard to imagine that Ray Rice's case didn't turn out exactly as the NFL intended. They imposed a harsh discipline and acquiesce on appeal, both parties get to save face.

(20,176 posts)The examples in the article are the most recent actions but not the best examples. At this point, they fold because it consistently seems to work better for them than losing even worse in a courtroom. Makes for great results for his clients but boring journalism.
I'd much rather they'd pointed out that he sued Goodell on behalf of several NFL players to break the most-recent lockout and that the NFL has free-agency explicitly because he won judgement on behalf of Freeman McNeil that forced the NFL to do so and on behalf of Reggie White to strike down the NFL's subsequent attempts to restrict player movement. The article is a synopsis...but the actual record is impressive. A legal scholar put the likelihood that Brady never misses a game at about 80%.
Between hiring Kessler and the fact that the Wells report is already being torn to shreds...it was speculation at-best meant to reach a per-ordained conclusion that the facts in Ted Wells' investigation turned out to not justify, later padded out with weasel words like "might", "probably" and "potentially." but devoid of certainty or proof. The logic here for the Patriots is simple...let Kessler destroy the NFL on Brady's behalf then Kraft will hire his own lawyers and go for the jugular, get the sanctions thrown-out and wave bye as the rest of the NFL board of directions joins him to vote to fire Roger Goodell.
Some people just can't stand that the Patriots never lose at anything.
