a cultural brain teaser...what would you do, who is responsible, is there blame...

German male escort's data hidden from paternity suit woman

A woman who got pregnant after having sex with a male escort in a German hotel has failed in a legal battle to find out his name.
The hotel where they spent three nights in 2010, in the city of Halle, does not have to tell her the man's name, a court in Munich ruled.
The man's right to privacy outweighed the woman's claim for child support payments from him, the ruling said.

If you want to answer, consider indicating if you are male or female. Just curious.

2. i'm not sure his privacy rights prevent her pursuing child support payments

i would think she could sue "john doe" for child support and the courts could somehow manage to handle the case without ever revealing the defendant's name or forcing him to appear in court at the same time as the plaintiff.

fwiw, i'm male (and neither pregnant (afaik) nor an escort)

3. I'm a female.

What's completely unclear from this article is whether the sex was unprotected or not. However, every form of birth control (other than outright sterilization) has a failure rate.

I wonder what, if any, contract she had with the escort service. I also wonder why she didn't have an abortion. I'm pretty sure that's what I'd have done in the same circumstance.

I also wonder what, if any, laws Germany has about paternal rights and obligations, especially when fathering a child out of wedlock.

As a female, although well past childbearing myself, I fully understand that in the end a woman bears almost total responsibility for children, and if you don't want to have and raise a child possibly on your own, you should be doing everything possible to prevent a pregnancy. Or ending one early on.

But I'm not that woman. She's not a friend of mine who asked me for advice back seven years ago.

If she's really determined to track down the guy and get child support from him, she could probably hire some sort of private investigator.

And my final thought: what is she telling her son about his father?

4. Children ought to be supported no matter their origins.

Any society that denies a child healthy food, safe and comfortable shelter, appropriate medical care, and education, sucks.

Doesn't matter if the kid was found in the cabbage patch and suspected spawn of the devil.

6. Responsibility due to her consequence(s)

She chose the activity & knew there were precautions needed to prevent pregnancy when having sex. Unless she wanted to get pregnant & try a form of entrapment-maybe the case here.

She should forget it & live her life in the best manner to support her child. Don't degrade the child in the process you knew what you purchased.

Male not that it matters.

10. There's certainly some irresponsibility involved there on both sides

I have to say though, more on her side. Why would she not insist on a condom, better yet, making sure she had taken birth control pills.

I mean she's the one who contracted with the escort service and consented to sex over a three day period. There's a very good chance of getting pregnant if no birth control measures are taken.

Also I'm wondering if she may have fallen for the guy since she didnt get an abortion. The circumstances suggest she wanted connection to him.

Male.

8. Disagree with court (female here). The child has a right to support from BOTH parents. Two to tango.

The issue is not that the privacy rights of a particular escort are being prioritized over the child's welfare, but rather that four random men named Michael can't be compelled to reveal their information simply because the woman might or might not have had sex with one of them seven and a half years ago.

That's a very different question, it seems.
