Judge's ruling bars state money to private schools for now

A judge this afternoon issued a preliminary injunction that bars the state of Michigan from distributing any of the money the Legislature allocated to private schools to help them pay for state mandates.

The verbal ruling from Judge Cynthia Stephens came during a hearing in the Court of Claims in Detroit.

"This was very important. If we didn't get the order that we got today, tomorrow the state of Michigan could start cutting checks to private schools for the first time in the history of our Constitution," said Daniel Korobkin, deputy legal director for the ACLU of Michigan, one of the 13 plaintiffs that filed a lawsuit against the state in March.

At issue is $2.5 million in public funding that the Michigan Legislature last year allocated to nonpublic schools to help them cover the cost of complying with state mandates. The lawsuit contends, among other things, that the public funding for private schools violates the state Constitution.
