Chief judge wants bigger burden for those suing debtors in NY courts

By Richard Moody

Chief Judge Jonathan Lippman announced a new rule on Wednesday that would impose a larger burden of proof on plaintiffs suing debtors for credit card debts, in an effort to reduce the increasing amount of false credit cases in New York.

According to Lippman more than 100,000 credit card debt lawsuits are filed in New York courts every year totaling "hundreds of millions of dollars." Lippman said the majority of these lawsuits are brought forth by third parties who buy portfolios of credit card debts providing little background on the debt.
