Central Hudson, NY Public Service Commission file lawsuits over capacity zone

POUGHKEEPSIE >> Central Hudson Gas & Electric Corp. and the state Public Service Commission have filed lawsuits asking that the Federal Energy Regulatory Commission respond to requests for new hearings over restrictions about where utilities purchase electricity.

The filings, in the U.S. Court of Appeals, include an assertion by Central Hudson that federal energy officials failed to respond to previous petitions asking that the new “capacity zone” rules either be delayed or phased in over a three-year period.

“FERC has not acted on these petitions in a timely manner, and we are pursuing this legal course to compel the agency to move the case forward,” Central Hudson President James Laurito said in a press release.
