Oklahoma law requiring hospital admitting privileges for abortion doctors tossed out

OKLAHOMA CITY — The Oklahoma Supreme Court on Tuesday tossed a law that would have required doctors who perform abortions to have admitting privileges at a hospital within 30 miles.

The court ruled that the measure, Senate Bill 1848 by Sen. Greg Treat, R-Oklahoma City, was unconstitutional because it created an undue burden on a woman’s access to abortion, violating her constitutional rights.

Norman abortion provider Dr. Larry Burns filed the suit challenging the law that was passed and signed in 2014.

The action wasn’t unexpected. The U.S. Supreme Court in June ruled that a similar Texas law imposed an undue burden on access to abortion.
