Family of dad crushed by Columbia Gorge tree sues Oregon for $2.2 million

The family of a 27-year-old father of three who was instantly killed when a large tree fell onto the car he was driving along the Historic Columbia River Highway has filed a $2.2 million lawsuit against the state of Oregon.

Jorge Figueroa's family faults the Oregon Department of Transportation for failing to cut down the tree before it fell just east of Latourell Falls near Corbett. The tree was decaying and had holes around its trunk from woodpeckers, states the lawsuit, which was filed Wednesday in Multnomah County Circuit Court.

The woodpecker holes were "easily visible" from the highway, the suit states.

A spokesman for the Department of Transportation declined to comment Thursday.
