Texas AG Greg Abbott seeks stay of 2 other same-sex marriage cases during appeal of judge’s ruling

The state of Texas wants to halt proceedings in two same-sex marriage cases during its appeal of a judge’s ruling in a third.

Attorney General Greg Abbott’s office filed a motion last week asking U.S. District Judge Sam Sparks of Austin to stay proceedings in two cases, Zahrn v. Perry and McNosky v. Perry, while the state appeals another judge’s ruling in the third case, De Leon v. Perry.

Last month, U.S. District Judge Orlando Garcia of San Antonio, ruling in De Leon v. Perry, struck down Texas’ same-sex marriage bans as unconstitutional. Garcia stayed his decision pending the state’s appeal to the 5th U.S. Circuit Court in New Orleans.

Prior to Garcia’s ruling, Abbott’s office had tried to combine the three cases in Sparks’ court.
