Judge says sexually assaulted 14-year-old 'wasn't the victim she claimed to be'

A man sentenced to five years probation by a Dallas County judge after admitting he raped a 14-year-old girl won’t have to follow many of the restrictions typically given to sex offenders.

And the judge who issued the light sentence said Thursday that she did so in part because the girl wasn’t a virgin and “wasn’t the victim she claimed to be.”

State District Judge Jeanine Howard, who gave 20-year-old Sir Young deferred probation last week, also altered Young’s probation requirements. As a result, Young does not have to stay away from children, attend sex offender treatment, undergo a sex offender evaluation or refrain from watching pornography.

While not required by law, these are typical probation requirements for rapists that are intended to prevent future victims and rehabilitate offenders.

2. I don't disagree with the judge on his punishment.

He is a great candidate for rehabilitation & she has set him up with a great program to do so (aside from the working with victims attempt). It is certainly better than throwing him in prison for the next decade.

3. An 18-year-old having sex with a 14-year-old is defined as statutory rape in Texas.

He already has gotten another girl pregnant, so what makes you believe that he is a great candidate for rehabilitation?

This sentence sets a very bad example.

occured & guidelines have been put in place that if he screws up he goes to jail.

Last I checked getting someone pregnant isn't considered a crime, however, if the female is underage then it's an issue.

Sentences are supposed to be handed down on an individual basis based on the nature of the offense & the character of the offender. At no time should a judge be handing down blanket presumptive sentences.

9. You are correct--getting a girl pregnant isn't a crime.

However, the guy certainly lacks the judgment to know when he needs to keep his pants zipped up. From the report in this newspaper and others (like the Dallas Observer) I don't see any mitigating circumstances as to why he should receive such a lenient sentence, particularly since the girl told the rapist to stop while the crime was being committed. The fact that the crime won't appear on his record if he completes his probation successfully is equivalent to a "get out of jail free" card if he does decide to commit another rape in the future.

The girl, her mother and the DA are absolutely correct in labeling this sentence as a travesty of justice. If I still lived in Dallas county I would consider voting for the judge's opponent in the next election and I haven't voted for a Republican in three decades.

11. I'm not arguing the kids guilt by any means.

I'm speaking from experience, I sat on several sexual assault prosecutions & said I will never ever work for defense. However, I have also given countless classes to thousands of soldiers regarding sexual assault bc of it's prevalence. Especially when you get a bunch of 17 & 18 yr old kids together who for the first time in their lives are without pretty close supervision. When I am talking to these kids I stress the no means no, to the point where if you think they may be pushing you back with their hands or shaking their head no stop & make sure what you are doing is consensual. Just bc it started out as a yes doesn't still make it a yes. (I tell my kids this as well.) Shit happens people change their minds, come to their senses whatever but consent isn't a binding contract.

With that being said I know he fucked up & yes, he's young & needs to keep his zipper up but rehabilitation may be in order in this case.

But she is most definitely the victim she claims to be.

Even if she begged for it.

12. Just more proof that you don't have to be smart or empathetic to be a judge.

Must have gone to law school on the Claytie Williams scholarship.

This creep needs jail time and lifetime registration as a sex offender. That's what he is, and this cannot be rehabilitated. Nothing connected to the sex drive can be.

See, my populist inclination is for a bit of street justice. Impeach the judge and get her out of there.
