Texas can implement key provision of sanctuary cities law
An appeals court Monday allowed the state of Texas to implement part of a law that punishes counties who dont honor immigration detainers.
The Fifth Circuit Court of Appeals on Monday issued an emergency stay of the ruling by a San Antonio federal judge that halted penalties for local jails that dont honor requests by immigration authorities to hold people suspected of being immigrants subject to deportation.
The appellate court was ruling on a request by the state for an emergency stay against U.S. District Judge Orlando Garcias ruling temporarily blocking parts of the law. The immigration detainer portion of the law can now take effect until a hearing scheduled for Nov. 6 on an appeal of the injunction itself.
Jose Garza, a San Antonio lawyer representing El Paso County in the lawsuit against Senate Bill 4, said the Fifth Circuit allowed the state to punish counties that have a blanket policy to not honor immigration detainers. After reading the ruling shortly after it came out Monday afternoon, Garza said he thinks it allows local jails some leeway about when they honor detainer requests.
