Judge orders Conroe restaurant to pay mom $1.6M after delivery driver fatally struck son

A Montgomery County judge on Wednesday ordered a Chinese restaurant in Conroe pay $1.6 million to a woman whose son died after being struck by a delivery driver as he walked home in 2019.

Around 8:30 p.m. April 2, 2019, Bobby Joe Johnson, 27, was legally crossing the 2500 block of FM 1488 in Conroe, walking to the apartment he shared with his mom, Telina Wheaton, after buying cookies for the two at a convenience store. While delivering food, a 19-year-old Golden Chopsticks driver eastbound hit Johnson with his black Nissan Altima, according to the lawsuit filed Feb. 10, 2020.

Johnson died of brunt force injury two days later at a hospital, according to the lawsuit.

Presiding 248th District Court Judge Kristin Bays awarded Wheaton $1,601,997 individually and $136,323 as a representative of Johnson’s estate. The total sum is to be paid by Golden Chopsticks’ owner Houston-based Mingrun, Inc., court documents show.

“Montgomery County has perennially been really conservative as far as judgments and a lot of verdicts that come on out that way,” said Paranjpe, whose firm is based in Houston. The ruling “just speaks really to the merits of the underlying case, and I think it connected to the judge as well.”
