In 2007, the Legislature passed a measure authored by state Rep. Harvey Hilderbran, R-Kerrville, that lifted the cap and required 94 percent of revenues from the sporting goods tax to be credited to the Texas Parks and Wildlife Department. End of story? Hardly.
Appropriators still have the ultimate discretion. While the sales tax is estimated to bring in $250 million during the current biennium, the Legislature actually appropriated only $26 million per year for parks. That's 21 percent of revenues, not 94 percent.
Lawmakers faced a historic budget shortfall during the last session. Even so, the consistent diversion of revenue streams that are supposedly dedicated for parks, trauma care, highways and other purposes is a fundamentally deceptive method of taxation.
