WASHINGTON -- They tried and failed to remove a local politician from office.

Now, Loudoun County taxpayers have to foot the bill for his legal fees.

A month after County Circuit Judge Paul Sheridan dismissed the recall petition of county Supervisor Eugene Delgaudio -- a document signed by more than 600 voters in Sterling, Virginia -- county taxpayers have to pay roughly $30,000 in legal fees, the amount it cost for Delgaudio's defense fund.

Loudoun County must pay $35,000 in attorney fees relating to the failed recall effort against county Supervisor Eugene Delgaudio (R-Sterling).

The Hon. Paul Sheridan, a retired Arlington County judge, made the ruling in Leesburg Friday afternoon. Sheridan last month dismissed the recall petition against Delgaudio, granting the request of Arlington Commonwealth's Attorney Theo Stamos, a Democrat who took on the case after Loudoun's commonwealth's attorney, a Republican, was recused to avoid the appearance of a conflict of interest.

Sheridan also determined Friday the proceedings and testimony from the 2013 special grand jury investigation into Delgaudio's office will remain sealed. The grand jury was investigating allegations that Delgaudio misused public assets -- claims that played a large role in the recall effort by nearly 700 of the supervisor's Sterling constituents.

Delgaudio Wins Reimbursement Of Legal Fees in Recall Effort

During what is expected to be the last day in court for Supervisor Eugene Delgaudio (R-Sterling) related to allegations he misused his constituent office resources, the county government was ordered to pay the legal fees he incurred in the unsuccessful recall petition effort.

Circuit Court Judge Paul Sheridan granted the motion by Delgaudio’s attorney Charles L. King to be reimbursed for $35,628.64 in billed time and costs incurred while defending the embattled supervisor in the recall case initiated by a petition signed by more than 600 Sterling District voters.
