Washington AG Ferguson sues gyms defying Inslee stay-at-home orders

Washington Attorney General Bob Ferguson is filing consumer protection lawsuits against gyms in Puyallup and Arlington that operate in violation of Gov. Jay Inslee's "Stay Home, Stay Healthy" proclamation.

The AG's office says both gyms have received multiple warnings that, by continuing to remain open, they pose a danger to public health. They are also, it argues, engaging in an unfair business practice because competitors have chosen to heed stay-at-home orders and remain closed.

By so doing, claims the suit, they gain an unfair advantage, and are violating the state's Consumer Protection Act.

The business owners are Michael J. Baker and Shane D. Cowhig of Fitness 101 Team Puyallup -- more popularly known as Northwest Fitness Co. -- and Michael and Richard Jellison of Power Alley Fitness, known as PA Fitness in Arlington. On Friday, both businesses received cease-and-desist orders, final warnings to cease operations within 48 hours or face a lawsuit.
