Inslee caps food delivery service fees, implores Congress to take further action

Gov. Jay Inslee on Thursday capped the fees charged to restaurants by third-party delivery companies in an effort to keep restaurants from being gouged at a time when delivery services are key to their survival.

Inslee limited fees on restaurant orders to 15% and total fees to 18% of a food order’s total. He also prohibited food delivery companies from cutting wages or tips for delivery drivers as a result of the capped fees.

Seattle Mayor Jenny Durkan issued a similar order in April directed at companies such as Uber Eats, DoorDash, GrubHub and Postmates.

Last week, as Covid-19 infections surged to the highest levels since the onset of the pandemic, Inslee once again banned all indoor dining and shuttered bars.

In a statement Thursday, the governor said app-based food delivery services are essential to keeping restaurants serving food during the outbreak, but he said those restaurants need to be protected from opportunistic fees. Inslee noted that fees tagged onto food delivery orders can reach as high as 30%, “creating an economic hardship for these food providers.”
