Dane County DA declines to press felony battery charges against Damon Terrell (X-Post from LBN)

Dane County District Attorney Ismael Ozanne has declined to file charges against Damon Terrell, nearly one month after he was arrested at the state Capitol on tentative charges of battery to a police officer.

"We had some questions and we didn't believe we could reach our burden," Ozanne said Monday morning.

Terrell was also facing tentative charges of resisting arrest and disorderly conduct.

A call for comment to the Department of Administration, which oversees the Capitol police, was not immediately returned.

According to Madison criminal defense attorney Robert Ruth, a number of factors must be proven beyond a reasonable doubt to be convicted of battery to a police officer under Wisconsin law. Included among them is that the defendant

Even in the cozy group hug on the floor he still insisted in abusing the officers fists. He went as far as to strain their muscles as he insisted they carry him as he so lazily hung from their arms.

And for several weeks deprived of his right to petition his government. For nothing.

It is so infuriating that the Capitol Cops who are on our side politically say that even though they don't necessarily agree with what s going on, "it will all get sorted out in Court." In the meantime, people are expending significant money for attorneys, and they're being deprived of their rights.

At least with a declined prosecution, the felony charge won't show up on CCAP.
