Worker hurt (2 killed) in International Nutrition collapse plans to sue plant owner

A worker who was seriously injured in the collapse of the International Nutrition plant last week in south-central Omaha is suing the company and its president, Steven J. Silver.

Attorneys for Tomas Balderas said they planned to file a complaint today in Douglas County District Court. In it, they argue that Silver and his company should have known — and properly prepared for — the risks that led to the deadly collapse.

Balderas' attorneys argue that company negligence was responsible for the disaster and for a long list of injuries suffered by their client. They say Balderas suffered injuries to his chest, spine and head, and that doctors had to insert a chest tube for his collapsed lung.

According to the suit, Balderas “will be unable to work because of his injuries and will suffer lost wages and other financial damages related to his injuries.”
