Policeman faces murder charge in Nakba Day shooting of Palestinian teen (Caught live by CNN)


A Border Police officer and his commander were arrested Tuesday over the killing of a Palestinian youth during Nakba Day protests six months ago will be charged with murder.

The Judea and Samaria District Police on Tuesday detained an enlisted border policeman on suspicion that he shot and killed Palestinian youth Nadim Nuwara. Two Palestinian teenagers, Nuwara and Muhammad Salameh, were killed during protests in Beitunia, near Ramallah in the West Bank, on May 15.

The policeman's commander was also arrested on suspicion that he knew that the policeman had shot the boy and not reported it. The commander was released to house arrest until Sunday.

For some time, there were contradictions in the army and police versions of the killing, according to which no live fire was used but only means to disperse demonstrations.

The district police, responsible for investigating the use of live fire by border policemen in the occupied territories, interrogated all the policemen present at the event. They denied using live rounds, despite Palestinian claims that the boys had been killed by live bullets.

Kafr Kanna, Israel - A police helicopter circled above and the wind carried a putrid odour as Israeli police forces sprayed skunk water on protesters at the barricaded northern entrance to this Palestinian village in the Galilee region of northern Israel.

Youths torched tyres and hurled stones, but were pushed back several hundred metres by the officers.

At a time when clashes between Palestinians and Israeli forces are gaining steam in East Jerusalem and the occupied West Bank, demonstrators enveloped the streets of Kafr Kanna on Saturday afternoon to confront a heavily armed riot squad to protest the police slaying of a local youth in the early hours of Saturday morning.

"Every time there are tensions in Jerusalem it extends to the north as well," Najwan Berekdar, 32, a Nazareth-based activist who marched in Kafr Kanna, told Al Jazeera.

"Israeli forces have grown more violent against Palestinians in [present-day Israel] in the last few years. They want to make a point that we are still Palestinians at the end of the day, despite our Israeli citizenship."

The arrest appears to prove what footage and family indicated from the start: Live bullets were fired at protestors, unlawfully, as the victims posed no immediate threat.

A Border Police officer was arrested Tuesday on suspicion of shooting Nadim Syam Nuwara (17) with live ammunition, one of two Palestinian teenagers killed during Nakba Day protests in the West Bank village of Beitunia last May. The border policeman is being charged with murder and his commander is also facing charges for not reporting the incident.

The shootings, which were caught on film by CCTV cameras, showed that the protesters posed no immediate threat to the soldiers at the time they were shot. It was unclear whether the policeman was also implicated in the killing of Mohammad Mahmoud Odeh, 16, who was killed under nearly identical circumstances in the same place on the same day. The investigation into the incident is being conducted by a unit with the police force.

Got me thinking .... would need to do some research but the first name that popped into my head was Ami Popper....you can read about him here :

Was convicted for murdering Palestinians, but had also tried to kill Jewish Israelis as I recall. Will have to recheck later.

This is indeed very interesting.

Although I do not recall many recent instances of settlers or IDF being prosecuted and serving reasonably long sentences for killing Arabs, from your link, there at least has been a few cases in the past where they have. The Ami Popper sentence was interesting, I thought. Conjugal visits and furloughs - holidays from prison. Is it common that convicted murderers in Israel can get weekends off from prison to go into town?

Police failing to investigate Jewish hate crimes in West Bank, says NGO

Some 92 percent of complaints filed by Palestinians are closed and the criminal never found, according to a report by the Yesh Din human rights group, which has been tracking 1,045 complaints filed through the organization since 2005.

The list of complaints includes shooting attacks, assault, stone-throwing, arson, cutting down trees, animal abuse, crop theft, construction on Palestinian-owned land, threats and attacks. All the actions mentioned in the complaints were committed by Israeli citizens.

The statistics from 2013 and 2014 have led Yesh Din officials to conclude that the establishment of the new department set up the Judea and Samaria District Police to combat nationalistically-motivated crime has led to no improvement in the investigations. In addition, Yesh Din officials say that the percentage of failures of the Israel Police to investigate ideologically-motivated crime against Palestinians has only increased.

The investigative authorities have completed handling 106 of the 159 cases that Yesh Din is currently tracking. Two indictments were served against the suspects in only two of the cases (1.9 percent). In comparison, 86 cases were closed on the grounds of “criminal unknown,” seven were closed “for lack of sufficient evidence,” and two others were closed on the grounds that “no felony was committed.” After studying the investigative material, Yesh Din officials appealed the closure of nine of the latter cases.

These statistics mean that of the 106 cases in which investigations were completed, 89.6 percent were closed under circumstances that testify to a failure in the investigative process.

“The statistics prove that the high-flown statements about the fight against nationalistically-motivated crime were hollow,” says Noa Cohen, data coordinator at Yesh Din’s research department. “The new department has not improved by one iota the law-enforcement authorities’ ability to investigate and prosecute criminals suspected of harming Palestinians, and ideologically-motivated crime in the West Bank continues to serve as a tool of intimidation and the takeover of land.”

A spokesman for the Judea and Samaria District Police commented, “The Israel Police has not yet received the report, so no comment about the data can be made.”

After all, what
differentiates these prisoners from other prisoners such as Yonah Avrushmi, who
murdered Emil Greenzweig, the peace activist, or Yigal Amir, who murdered Prime
Minister Yitzhak Rabin? The argument generally voiced is that Israeli citizens
classified as “security prisoners” are not prisoners of conscience and not imprisoned
for their declared beliefs; at least some of them have been convicted of murder.


In the intervening years, dozens of Jews have been convicted and sentenced for
crimes committed with a national motivation. In the mid-1980s, members of the
Jewish Underground were imprisoned; in the 1990s, Ami Popper, who shot to death
seven Palestinian laborers seeking work in Rishon LeZion, and Yoram Skolnick, who
murdered a handcuffed Palestinian arrested for suspicion of planning a terror attack,
were handed life sentences. As we entered the twenty-first century, the activities of
the Bat Ayin Underground were exposed. The IPS, like Israel’s General Security
Services (GSS or Shabak in Hebrew), views the entire group as criminal prisoners.
Even though the Bat Ayin ring had committed crimes identical to those committed by
the Arab “security” prisoners – they had undermined public and state security and
had acted from identical national, religious or ideological motivations – and despite
their membership in an illegal organization, these Jewish prisoners, who had
committed terrorist acts against Arab citizens, were not classified as “security”
prisoners but as “criminal” prisoners. Moreover, throughout their confinement, they
continued to enjoy the same conditions or privileges enjoyed by “criminal” prisoners:
they had daily telephone access, they received passes to leave the prison (e.g.,
furloughs), they were allowed open visits and conjugal visits, and they were able to
father children.

The source of this differential treatment can be found in the pressure exerted by
right-wing politicians together with the influence of rabbis who convinced the IPS and
the GSS to treat Jewish prisoners with leniency. The trip taken by members of the
Jewish Underground to the beach at Netanya escorted by IPS guards and officers
effectively ended the illusion of uniformity regarding the referents of the term “security
prisoner” and transformed it into a synonym for Arab inmates.

Relatives of one of the two Palestinian youths shot to death in Beitunia on Nakba Day praised the Jerusalem Magistrate Court's decision Wednesday to extend the remand of the border guard suspected in the incident.

Judea and Samaria District Police, who arrested the guard, is investigating a charge that he used live fire when shooting at Nadim Nawarah, 17, and Muhammad Salameh, 22. The guard's remand was extended by six days.

Israeli Court Convicts 3 Jews In Terrorist Killing Of Arabs

JERUSALEM — A court Wednesday convicted three Jewish West Bank settlers of murdering Arabs, bringing to a close a 13-month Jewish terror underground trial.

The three-judge bench read out its verdicts against 15 Jewish defendants to a packed but quiet Jerusalem courtroom at the conclusion of one of the longest and most controversial legal cases in Israeli history.

The trial has gained the the violent Jewish underground sympathy from Israel`s right-wing hard-liners, including Deputy Prime Minister Yitzhak Shamir. Many have called for lenient sentencing or pardons.

Ten Jewish settlers also were convicted of conspiracy to blow up the Dome of the Rock mosque on Jerusalem`s Temple Mount, the third holiest site in Islam.

Four were found guilty of attempted murder in the abortive bombing of Arab buses in Jerusalem last April, the incident that revealed existence of the terror underground and led to the arrest of members.

In a suprise ruling, eight defendants accused of planting bombs in the cars of two West Bank Palestinian mayors in June, 1980, were cleared of attempted murder but convicted of causing grievous bodily harm.

Nablus Mayor Bassam Shaqa lost both legs above the knees in the attack, and Ramallah Mayor Karim Khalaf lost a foot. Shaqa was removed from office last year and Khalaf died earlier this year of a heart attack.

All 15 defendants were convicted of either membership or activity in a terrorist organization, as well as lesser charges such as illegal arms possession and failure to prevent a felony.

Sentencing was set for Sunday.

Those convicted of murder in the July, 1983, gun and grenade attack on the Islamic College in the West Bank city of Hebron, in which three Arab students were killed, face mandatory life imprisonment. Two others, convicted of manslaughter in the Hebron attack, face maximum sentences of 20 years.

Attempted murder, manslaughter, causing grievous bodily harm and activity in a terrorist organization all carry maximum sentences of 20 years. Illegal possession of arms carries a maximum 10-year sentence, while conspiracy and membership in a terrorist organization each carry maximum sentences of five years.

Israel`s Shin Bet security authorities arrested 27 Jewish terror suspects last April. Ten already have been handed jail terms ranging from 15 months to 10 years. The trial of the remaining two, both Israeli army officers, is expected to begin soon.

Among those convicted Wednesday of virtually all charges was the terror network`s leader, Menachem Livni, a religious 38-year-old former army battalion commander who recruited and trained most of the group and planned its attacks. Investigators learned that Livni was considering using a plane to bomb the Dome of the Rock mosque.

The rest of my quote...

Correct me if I'm wrong but there probably hasn't been the same condemnation of Israeli terrorism against Palestinians because there hasn't really been this kind of terrorism perpetrated by Israelis against Palestinians. When there has been we have seen this same condemnation, both from inside as well as outside Israel. And the perpetrators were arrested in those cases.
