Los Gatos: New restrictions approved for gun shops

LOS GATOS -- Nine months after the opening of a gun shop sparked a public outcry, town leaders have approved regulations that severely limit where firearms dealers can operate.

"This clearly allows a gun store to exist in town, whether it's the incumbent relocating or a new one moving in," said Mayor Barbara Spector.

The decision was the end result of protests that began in December, when Templar Sports opened its doors just days after the school massacre in Newton, Conn.

Many residents -- who had no idea a gunshop was coming to town -- felt blindsided. And, the uproar that followed peaked earlier this year when overflow crowds packed public hearings. But the fury calmed considerably when the city started working on the ordinance that landed in front of the Town Council on Monday.

The new rules allow for gun vendors in town, provided they get a permit that must be renewed annually. The vendors also must be at least 250 feet away from youth-oriented businesses, schools, day care centers, government buildings, churches, parks and trails.

The permit is common sense (but annoying to the radical libertarians). The second part about keeping the store away from those listed areas sounds like pointless NIMBYism and is less acceptable than the permit part.

It's unclear if that means three vacant commercial properties or three total commercial properties.

The new rules allow for gun vendors in town, provided they get a permit that must be renewed annually. The vendors also must be at least 250 feet away from youth-oriented businesses, schools, day care centers, government buildings, churches, parks and trails.

That means there are three sites that would work for such a use, and while one of them is across the street from the current gun store, Templar's spot on University Avenue is not on the list.

The council agreed to give Templar four years to become compliant by either losing the guns or moving.


Odd story.

aren't most of the other places in residential areas? I don't see the logic behind churches, parks, and trails.

the possible places to none, they should have gone to 300 feet to rid those last 3 possibilities.









Do they not do the same thing for abortion clinics? sad when we use the same tactics

Chicago tried that with a 1/4 mile limitation, obviously to keep all gun stores and ranges out of the city.

They lost all the way to the Appellate court. The actual phrase the judge used was; "Chicago is trying to be too cute by half on this regulation and they need to stop now".

Now Rahm is required to change the law and pay roughly $1.2 million in legal fees for the NRA and SAF. He keeps this up and he'll get a free Life membership from Wayne for all his $$$ support.

But I'm sure all the very supportive gun control people here will be happy to send personal checks or offer their PayPal account numbers to offset the fines and court costs for Chicago and Los Gatos, right?

that some residents don't like guns. The existence of a gun shop does not create any inordinate crime, noise, safety, litter, traffic, or other impact that would justify exclusion from particular areas. Even the permit - which another article says was discussed as being $4000 (per year?) - seems more like an attempt to create an arbitrary financial barrier than anything else.

What might be reasonable would be requirements for burglar alarms, or secure storage for the inventory after hours, or even a building construction that would contain a negligent discharge.

Stories like this are really good arguments in favor of state preemption...
