Marissa Alexander, domestic violence and concealed carry

Marissa Alexander had a Florida CCW. Some questions for those of you that oppose concealed carry - was Marissa Alexander's gun a net positive or negative for her? Do you think she should not have had a gun?

There were two high profile Florida cases involving concealed carry, George Zimmerman being the other. Much was said about CCW and the type of people like to carry concealed. I wonder if those same lesson apply to Marissa Alexander or are there different lessons to learn from her case.

No - the appeals court ordered a new trial. And it was the judge that screwed up, not Corey. hack89 Sep 2013 #2

Let's hope the two will both file a malicious prosecution suit against Corey.

I don't think self-defense allows for a 'warning' shot. Either she feared for her life or she did not.

Since Florida has the gun law where there are extra penalties for using a gun she still seems to be in some trouble.

The one article I read heavily suggested that the "warning shots" were very much not warning shots according to the CSI notes.

There are to many stories.

I think the problem is that the jury got possibly incorrect instructions from the judge. That may have happened with Zimmerman too. It's complicated by Florida law as well.

It is a link from Legal Insurrection. While I disagree with the site's owners views on the proper role of governments involvement on the economy and providing social safety nets etc, he seems to be one of best authorities on self defense law.

That didn't happen in the Zimmerman case at all. Zimmerman case was prosecution eyewitnesses seeing Z scream for help while getting his head beat in the sidewalk. That isn't to say there wasn't errors in that trial. There were several Brady violations, which would have resulted in overturning any conviction.
Playing hide and go seek with evidence is a BFD in Florida, which can put a lawyer or technician in jail. That is why Corey's IT guy was lawyered up and now filing a wrongful termination suit.
