But even if he was and convicted, he'd probably get credit for time served.

which rarely happens, or if the local US attorney files. Since he would be going from the state to federal system, I don't know how the time served goes.
The most overlooked part of Fast and Furious is how lazy assed the Bush appointed US attorney was. The ATF office had video and other evidence that would be slam dunk straw purchase convictions, but the US Attorney, who replaced one of the ones purged, was too busy scouring the reservations in search of voter fraud to be bothered.

It is actually Castle Doctrine, since it is in the home. Legally blind is entirely different. Without my glasses, I'm legally blind and would be crime to drive a car, but still can see very well as long as I don't have to read signs. With glasses of course, I am 20/20.

I'm curious to see what the evidence was that lead to the judge's decision. The article doesn't mention it. It does spend a lot of space on information that isn't relevant to the case.
