LAS VEGAS (FOX5) -An armed convenience store clerk told police he was defending the business from a beer thief who was shot in the head early Sunday.
According to an arrest report, 55-year-old Mariano Tejeda-Zuniga was booked into Clark County Detention Center in connection to a shooting that happened about 3:45 a.m. in the 2100 block of Maryland Parkway.
Las Vegas Metro police said officers looked into the incident after receiving a call at about 4 a.m. of a man being admitted to Sunrise Hospital with a gunshot to the head. Two people who were with the wounded person told officers they were at a 7-Eleven store several blocks away from the hospital when the shooting happened.
They said a clerk followed the victim as he was exiting the store and shot him in the head. The victim collapsed but later got up and ran to a vehicle, fleeing the area.

(39,215 posts)1. He should have called the robbery into the police. Now that he did not it looks bad.

Shooting people in order to protect beer is not self defense, anyone who would defend something like this should not have access to guns.

If the thief is running away, they're no longer a threat to one's life and shooting him/her is a big no-no.
The clerk should, and probably will be prosecuted.

But "later got up an ran to vehicle"
Just pointing that out.. Lt that sink in a minute.
Pistol rounds are notoriously inconsistent in terms of wound outcomes.
As for the clerk.. FLEEING beer thief is not a deadly threat, charges will be forthcoming. as well they should be.
