SIMON -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to the sale of ammunition for assault weapons The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 270.00 of the penal law, as 2 amended by chapter 180 of the laws of 1997, is amended to read as 3 follows: 4 4. Sales of ammunition not prohibited. Nothing contained in this 5 section shall be construed to prevent, or interfere in any way with, the 6 sale of ammunition for revolvers or pistols of any kind, or for rifles, 7 shot guns, or other arms, belonging or which may belong to any persons 8 whether as sporting or hunting weapons or for the purpose of protection 9 to them in their homes, or, as they may go abroad; and manufacturers are 10 authorized to continue to manufacture, and wholesalers and dealers to 11 continue to deal in and freely to sell ammunition to all such persons 12 for such purposes. Provided, however, the sale of ammunition for assault 13 weapons, as defined by subdivision twenty-two of section 265.00 of this 14 title, shall be limited to two times the capacity of an authorized weap- 15 on over a one hundred twenty day period. For purposes of this subdivi- 16 sion, "authorized weapon" shall mean a weapon registered in accordance 17 with subdivision sixteen-a of section 400.00 of this chapter. Notwith- 18 standing any law, rule or regulation to the contrary, the violation of 19 this subdivision shall constitute a class E felony. 20 § 2. How would the seller know which type of weapon the ammunition is being bought for?

1. If the owner has 25 mags holding 100 rounds each...
...that sounds like 5,000 rounds every 4 months.

5. NY has a ten-round mag limit.
That means that the gun's "capacity" is ten rounds. In other words, you can buy 20 rounds every four months.
The interesting question is what constitutes "ammunition for an assault weapon." Given that there are "non-assault weapons" in every caliber used by "assault weapons," one can only assume they would use the SAFE Act's registry of assault weapons to determine who can buy one box of .223 every four months and who can buy as much as he/she wants. Ammunition sellers then would have to be given access to that registry -- the one that we were told was going to be so benign -- to use as a tool in denying or limiting sales. Such a scenario is highly unlikely, since the background-check-for-ammo provision of the SAFE Act has already been shelved as an expensive boondoggle. When they first floated this piece of dreck, the intention was to apply it to all firearms. Five-shot snubnose? You get ten rounds. Double-barreled shotgun? You get four. Save up your allotment for two years and you'll have almost enough to shoot one round of trap or skeet. I can't imagine that the people who dream this stuff up actually think it is in any way reasonable or even potentially effective. They're just casting around for anything they can think of to fuck with gun owners. |

That refers only to what you are allowed to insert into the firearm. I don't read anything that artificially limits the "actual" capacity.
There's a rather famous Democrat who had something to say about peaceful revolution. ![]() The "people who dream this stuff up" are uninformed unthinking morons. ![]() They should flush themselves. |

That refers only to what you are allowed to insert into the firearm. I don't read anything that artificially limits the "actual" capacity. No, it actually refers to what you are allowed to own. In NY it's illegal to own a magazine with a capacity of over ten rounds, even if you don't own a firearm. |
