The U.S. Supreme Court decided this week not to hear Jackson County Sheriff Mike Winter's legal challenge that asserted U.S. law trumps state laws when people with medical marijuana cards seek concealed handgun permits.

The sheriff argued that he couldn't give the license to Willis because that would violate the Gun Control Act of 1968. Winters has lost every court case on the issue so far, including one before the Oregon Supreme Court.

It will be interesting to see how this turns out. Will their be an introduction of more laws? If a user can get a concealed carry permit, why then can't they buy a gun under the same circumstance?

(754 posts)The specific mention of "marijuana" in form 4473 is repugnant, esp. since no other drug is so identified. The core of culture war demands that whole swaths of people be condemned, be they gun-owners, gays, ganja smokers, etc.

She said there is no evidence to support the idea that medical marijuana patients are more prone to abusing gun rights than any other segment of the population.
Just as there is no evidence to support the idea that concealed-carry folks are more prone to abusing gun rights than any other segment of the population.
That damned "marijuana" proviso in 4473 is nothing but a gratuitous turd in the punchbowl.
