Dunn is accused of shooting and killing Davis after an argument over loud music in a gas station parking lot in Jacksonville, Florida. Dunn claims the teen was threatening him, and he shot Davis in self-defense. Police never found a weapon on Davis or in the SUV he was in.
Before opening statements begin next week, HLN is taking a look back at everything that has led up to this moment, including stepping into Dunn's world behind bars. Twenty-five of his jailhouse letters have been released to the public, according to Jacksonville's WTEV.
While claiming in a letter to his grandmother that he's not a racist, Dunn repeatedly refers to Davis and his friends as thugs, and in a letter to his daughter he talks about how "the jail is full of blacks and they All act like thugs."

The jail is full of blacks and they all act like thugs. This may sound a bit radical but if more people would arm themselves and kill these (expletive) idiots, when they're threatening you, eventually they may take the hint and change their behavior.
I'm really not prejudiced against race, but I have no use for certain cultures. This gangster-rap, ghetto talking thug 'culture' that certain segments of society flock to is intolerable. They espouse violence and disrespect towards women. The black community here in Jacksonville is in an uproar against me -- the three other thugs that were in the car are telling stories to cover up their true "colors."
I am amazed at what is going on with the way the media has been covering this case. Their [sic] have been several other shootings here in Jacksonville, yet they are all either black-on-black or black-on-white, and none of them have garnered any attention from the media. I guess it's news when someone dares to not to be a victim, but they are twisting it around sand saying I was the "bad guy."
That last quote - 'When someone dares to not be a victim' - I guess we'll have to wait and see until the evidence is released but as I understand it -
There were three other men in the car.
Not one of them had a gun.
There were other witnesses at the gas station.
He was not threatened - just a drunk.
They (he and his female partner) ran from the scene of the crime. Even the Zimpig stuck around. That's right - even the Zimpig stuck around.
Thought I would start this for anyone wishing to discuss but maybe bruised a little around the psyche from the Trayvon Martin Murder Trial.

I don't believe Jordan Davis is going to be treated as fair and square and given a shot as Dunn would have been - in Florida - if Dunn had been the victim.
But - Davis' parents did settle the civil suit and I'm assuming to their satisfaction. That's huge - they weren't dependent on Angela Corey - and got some sort of justice.
But Ms. Corey being Ms. Corey - and that little area of Florida being what it is - I don't trust the jury won't get lead to believe that just being black to 'some people' and within 10 feet of them means you are automatically going to violently assault them with a bag of candy or something.

If it happens again, I'll break my tv.
They should have had a guilty verdict after five minutes. Guilty.

(4,713 posts)These issues hit very close to home, I grew up in South Florida & am raising 2 teenage sons in SC. I dealt with some scary shit as a teenager/young adult & hate that I'm having to raise my boys with these same fears.
Our children should not have to be in fear of their lives simply because of the color of their skin.

(31,780 posts)Though jury selection has lasted three days -- after which the judge is expected to order that the jurors be sequestered -- the trial should proceed quickly and shouldn't last past February 14, two days before what would have been Davis' 19th birthday, said John Phillips, an attorney for the family.
Dunn's attorney, Cory Strolla, said that as of Tuesday evening he had filed no motion to dismiss the charges based on Florida's stand your ground law, which received national attention during the George Zimmerman trial.
"We are relying on Justifiable Use of Deadly Force as an affirmative defense," Strolla said in an e-mail to CNN
Might be breaking the four paragraph rule here - but down a bit in the article there are mentions of the police investigation - this took place after Dunn and his girlfriend kept driving to their chi chi poo poo bed and breakfast where they ordered pizza. . . Yeah - I'm pointing out this cause him absolutely no distress.
Quotes from the Interrogators at the PD:

Adds the other interrogator, "Let me be the first to tell you, this ain't one of them."
Three days of jury selection thus far and they still to intend to close the trial next week. Also it's looking like the jury will be sequestered.

Strolla set up a portion of his legal argument, telling prospective jurors that a "two step" rule permits gun owners to keep carry weapons even without a concealed weapons permit, as long as they physically have to transact two steps in order to obtain and unholster their weapon. He reminded jurors that he had no obligation to prove his client's innocence, but that it was the state's obligation to prove guilt
This doesn't bode well for Jordan. . .

Appellate court again overturns order by judge in Michael Dunn murder case
The media organizations requested the phone calls and Healey ruled that they are public record and should be released. But Corey said she would not release the calls until her staff spends about 180 hours redacting them and media organizations pay $6,000 for their time. That is expected to take nine to 10 weeks, according to Corey.
Attorneys for the media went back to Healey and asked him to order the release of the phone calls immediately and to find the $6,000 excessive. Healey declined to rule, saying that the media needs to sue Corey in civil court.
But the appellate court said Healey was wrong to do that, and he should be the one to make the decision. It ordered him to hold an evidentiary hearing and rule on the merits of the media motions.
But the appellate court also acknowledged that with the trial beginning Monday that would be difficult. It recommended that Chief Judge Donald Moran consider appointing another judge, a magistrate or a special master to consider the issue as soon as possible.
You have to answer a two question survey at the Jacksonville News to read the entire article - but it's worth it. This judge was trying to keep the jury pool clean after a 'yikes' moment re the racist phone calls from the jail to Dungheap's family.

My understanding is Strolla (defense atty) put out there in opening arguments that this poor kid had a four inch knife.
Trying to connect the dots - but the ME today said there was no way Jordan was standing up when he is shot.
Having seen a jury from this area in action this summer - I'm going to cross my fingers that they disregard that outright lie from Fibber McGee there.

Defense has two witnesses and should rest their case tomorrow.
If the defense tells that lie about a knife and the prosecution allows it to slide - this guy walks. And Corey being Corey - she will allow them to get away with it.

(885 posts)But she was definitely emotional on the stand. She was there to impeach his previous testimony regarding his calling his law enforcement friend. They received a call from him shortly after the shooting. He gave no indication on that call that anything happened. This is the same guy he called the next day saying he was in trouble.

(53,661 posts)Let's see, says that this kid said something to him, cursed or had a knife. Excuse the fuck outta me, but Dunn was outside the car. Dunn has a gun with him. His vehicle is fueled up and ready to go. It works, no one is stopping him.
Just where is the balance of power? Were the magic words and the magic knife gonna kill him if he backed away from the kid and the other vehicle, and him having a gun? And he can't go to his vehicle and leave for help?
Just fucking lies and bullshit. And from what I'm reading here of how the court room is beting handled, this bastard is gonna walk! WTF is wrong with these people?
Don't they know the whole nation knows what they are doing? That this is wrong? Are they that fucking arrogant, and dare I say - racist - to think they are going to get away with this?
This is worse than Z, and I was sure he was going to jail. The woman he had molested as toddler thought so too!
This is open and shut, you don't go to a vehicle, start a mess, and not expect to get some pushback. He could have left, for fuck's sake!
But his writings about how the blacks needed to be killed to teach them not to threaten someone is so flipping psycho I don't know how twisted a person would have to be to agree with him. Florida has got something seriously wrong going on down there.
I've never been to Florida, and frankly never wanted to visit. It appears to be some kind of benighted region that can't stop being racist.
Now there is a commissioner that cut off most of the polling places in a minority area, as he says, he wants it as hard to vote a person having to walk 200 miles in Africa!
He said that! In 2014! Damn, I don't know what to say. Just damn it all to hell.
Sorry, but I can't watch or listen to this damned thing in that courtroom. I can't have that in my brain. I'll check back here for whatever turns out to happen.
And it looks like it's going to be just let the bastard go. After all he said. All he did. Just walk away. I wish there was a way to declare martial law on that area and send out a mental health worker to every house and root out this damned racist insanity.

(31,780 posts)And yes it's disgusting how that court room was handled. My boss called me into his office yesterday and we shut the door and watched Dunn's testimony. My boss - an almost 60 year old white man who grew up in the NYC area kept saying, "this is utter bullshit!". But we had discussed this case after Trayvon did not get justice and he was sickened by that verdict and pointed out - if those windows had been tinted - it could have been one of his sons . . . Who blast rap music in their car. He cares because "the gunners and bigots are out of control."
If that group of jurors - who during jury selection had a few tee hees about the clean up after gun violence vs other forms of murder have bought his "key words" then he will walk. He's not even using SYG - he had to convince them that his uh - er - 'method' of handling the conflict HE STARTED was justifiable. Sick.
I'll say this though - the people of The Republic of Key West - they are worth visiting if you ever get the chance. I'm convinced we will never hear of this stupidity in their little slice of Florida.

I feel it was directed at this group or some other groups, and don't want to cause more trouble than I obviously do. It got Recs, but only a couple of kicks. People that do not post in AA are reading the words here and refer to what is said but do not name names.

(53,661 posts)What I'm saying is, I hate to bring it to a safe haven like AA. I may have missed hidden posts here or who's blocked, so I don't know how it's been going here since the group was set up here on DU3.
Plenty have showed their asses in the BOG and I've offered to delete threads when members feel bombarded. We've had to post warnings and head threads with 'BOG.'
Always claimed they didn't know where they were, after they dropped their pants and took a dump - not talking the point, just abuse. I don't think that should be in GD, either.
I'll keep following that live blog link I posted and this thread. Now that the jury is sequestered, we won't know what is going to happen.
The trial was very short, IMO.
Did it seem that way to you?

There is a bright spot to offset the chance of a bad jury - its Guy. He gave it all in Zimpig's trial. He was visibly upset at that press conference. He worked with what he had.
Same here . . . And I think that one detective that the Defense Attorney kept hammering about the Magical Mythical Non Existent Gun - The one that when asked, "Why did you go back to look at ther roof?" answered - "Because I knew you would ask?"
He's banking on that guy.
But if that jury believes this gun nut's Magical Mythical Non Existent gun theory - done.

Jurors could have decided not to convict Dunn on that charge but instead find him guilty on lesser charges such as manslaughter. Or they could have acquitted him altogether on this count.
With the hung jury, State Attorney Angela Corey said prosecutors would press for a new trial in Duval County on the murder charge...
Prosecutor Erin Wolfson explained Saturday night that each attempted second-degree murder conviction carries a minimum sentence of at least 20 years. There's also a 15-year sentence possible on the shooting conviction...
Lucia McBath said -- even without a decision on the murder count tied to Davis, her son -- her family is "so very happy to have just a little bit of closure."

Despite Corey's statement of:
"Justice for Jordan Davis is as important as it is for any victim," Corey said.
I feel she was wrong to disallow the emails. That showed malice aforethought, but I'm not sure that this is the way Florida law states such matters. And as usual, my disclaimer, 'Not an attorney.'

(53,661 posts)My main hope is he never gets out of jail again. That malice is engrained, he'll never change his mind, he's a menace to society and should be kept behind bars.
Sorry, but there comes a point when there is no point letting a person who justifies killing others all the time run loose and have a chance at shooting at people. I hope this will change the law there, or if not that, change the opinion of those who think they can play God because of a gun, or an accident of nature or fate.
IMO, that is what being born one color or another, one sex or another, in one place or another is all it is. All that stuff is bullshit, the human spirit is not confined by those things.
My joke is, to watch what you say you love or hate. Because if there is such a thing as being reincarnated, what you focus is what you will be in the next life. Just an example of what goes around comes around, not expressing a deep belief there. When I say that to racists, their eyes get big!
