Judge Recuses Herself Form New Trial in Ohio Police Shooting

The judge who presided over the trial a white former University of Cincinnati police officer in the fatal shooting of a black motorist has removed herself from the case after the first trial ended with a hung jury.
Hamilton County Judge Megan Shanahan said Monday a new trial should be conducted "with a blank slate." The case was randomly assigned to another judge, who will decide pending matters including the prosecutor's effort to move the trial to another jurisdiction.
Prosecutor Joe Deters (DEE'-turs) has said he will retry Ray Tensing on murder and voluntary manslaughter charges in the July 2015 shooting of Sam DuBose, but wants a jury away from intense local attention.
Before removing herself, Shanahan rejected a defense motion to acquit Tensing after the Nov. 12 mistrial.

CINCINNATI, OH (FOX19) - Ray Tensing will be retried on charges of murder and voluntary manslaughter in the shooting death of Samuel DuBose, Hamilton County Common Pleas Court Judge Megan Shanahan ruled Monday.
She refused a defense request to acquit the former University of Cincinnati police officer and then recused herself from the case.
Hamilton County Common Pleas Court Judge Tom Heekin will take over. He was appointed earlier this year and then re-elected.
Hamilton County Prosecutor Joe Deters asked for the retrial after Shanahan declared a mistrial on November 12 with the jury hung on both counts.
