the selective release of the autopsy report sounds to me as though there will be civil rights charges brought in Ferguson, even if the Officer is not indicted.

(31,681 posts)Justice Department to investigate Ferguson Police Department
The Justice Department is expected to announce Thursday that it will open a broad civil rights investigation into the Ferguson, Mo., Police Department in the wake of the killing of an unarmed 18-year-old black man that touched off weeks of unrest..
The new civil rights investigation will be in addition to the federal criminal probe already underway as to whether Officer Darren Wilson, who is white, violated Michael Browns civil rights or used excessive force after a confrontation between the men Aug. 9.

More:
The investigation of Ferguson's police, first reported by the Washington Post, is not out of character for Atty. Gen. Eric H. Holder Jr., who has aggressively investigated police departments across the country over the last five years.
Since 2009, his department has brought 33 legal actions against departments for their policies or alleged abuse, including in Albuquerque, N.M., and Newark, N.J. So far, 16 cases have yielded rulings or settlements resulting in reforms.
Oh - but he won't back off of pot - so he's worthless .
Can't copy/paste anymore but the article states that the DOJ would have to show Racial Motive or that Wilson used disproportionate force for the situation.
Racial disparity and a Police Department that has A HISTORY OF USING EXCESSIVE FORCE AGAINST ITS EMPLOYERS/CITIZENS says . . . I be they bring a case.

(31,849 posts)Can't be true ... I read here on DU that the DoJ has NEVER, ever, ever, found against a police department.
I posted this to another thread:
No one has disputed that there was a scuffle at the vehicle or that a shot was fired in the vehicle ... In fact, that goes along exactly with what the first witness said happened.
The point in controversy is whether Michael reached into the vehicle, pummeling the officer, while reaching for the officer's gun ... AND THE AUTOPSY (from what I've read) IS COMPLETELY SILENT ON THAT.
So isn't it AS likely, that the autopsy report supports the first witnesses comment, that the officer grabbed Michael by the neck, a shot (or two) was fired and Michael pulled away and ran? It makes perfect sense that someone, when being dragged towards a gun, would reach out in an effort to control the gun.

(16,286 posts)WORST CASE SCENARIO
Cop pulls up, very characteristically orders the kids to not jaywalk (remember, it is a statistical fact this police dept funds itself by ticketing the Black community for everything and anything), Brown mouths off to the cop while at the same time he is standing very near the door by coincidence, the cop pushes to open the door but Brown is there and Brown sees the cop go for his gun so Brown reaches in to take it away from him so he wont be shot and a shot is fired, scuffle results in a minor injury to cop and Brown is shot once.
Should Brown have not mouthed off to the cop, if he did? Sure, especially cops in that town (like thousands across America) where he knows he is gonna get shit for it...Should Brown have not reached into the car if he did? Right, he should not have, but I am white and I would not because I would assume the cop wouldnt shoot me for no reason, so who knows.
Anyway, back to the crime scene, Brown now runs off and Wilson fires one shot, Brown jerks to the sound of it so as to stop and turn, which he does, at this point we have several witnesses who say one thing and NO witnesses that are wiling to be public saying anything else, we all know what they all say so at this point Brown is executed.
EVEN if BROWN initiated EVERYTHING at the car, once Brown is 25 feet away, already shot and injured, he no longer represents a threat and you cant shoot him if you follow protocol.
By the way, what in the hell is this?

(31,681 posts)This could be really huge - because the folks of Ferguson have not let up pressure.
If they bring charges and it is successful - and we don't see a complete return for black Americans back to the 1920's . . .
This could be the start of something big. Something that moves us forward. Because it would mean that Ferguson has provided a road map to justice.

(31,849 posts)that it was not responsible for the leaks ...
I believe that! I also believe in the Easter Bunny, Santa Claus and the Tooth Fairy.
I imagine this, too, will be a part of any DoJ investigation ... tying the Prosecutor to all the other police misconduct.

(31,849 posts)that if we would just run a progressive enough candidate (e.g., WILL jail the bankster, WILL shut down the NSA, WILL divert all miltary funding towards Green Energy and the Social Safety Net, WILL tax the wealthy at 100% and directly transfer the revenue to the working class, and WILL oppose ALL trade agreements) ... we will win Kansas, Montana, Mississippi, Georgia and South Dakota ... hell, all races in every district!
Top that for fantasy beliefs!

(7,908 posts)theme here and post in General Discussion, so that your efforts reach a wider audience.
I have been thinking the Ferguson PD's failure to comply with Missouri's open records regulations might be folded into a larger "Conspiracy to Obstruct Justice" indictment against Jackson and the command structures of the Ferguson PD and St. Louis County PD. IANAL so not sure whether this is even within the realm of possibility, but one can always hope.

(31,849 posts)But I am on a self-imposed, two week, moratorium on discussing anything remotely related to race in the GD.
The DoJ is in the middle of an investigation of, not only the shooting of Michael, but the Ferguson PD and Courts' operation. With these leaks, there certainly is the stench that the rot is everywhere ... investigating the source of the leak would prove or disprove the extent to the rot, i.e., whether it extends to the Prosecutor's Office.
KingCharlemagne
(7,908 posts)Ferguson PD. I think the DoJ would be justified in expanding the scope of the investigation to encompass all of St. Louis County. Make McCulloch, Dotson and their goons sweat under the threat of federal indictments and not merely the Mayberry Machiavellis of Ferguson.

(31,849 posts)I got a post hidden for something I didn't say, but apparently the jurors heard. But, this:

REASON FOR ALERT
This post is disruptive, hurtful, rude, insensitive, over-the-top, or otherwise inappropriate.
ALERTER'S COMMENTS
ad hominem attack by association? Will Pitt has never posted anything racist to DU that I have every seen; certainly no watermelon jokes. This is pure disruption here.
JURY RESULTS
A randomly-selected Jury of DU members completed their review of this alert at Tue Oct 21, 2014, 09:40 PM, and voted 5-2 to HIDE IT.
Juror #1 voted to HIDE IT
Explanation: No explanation given
Juror #2 voted to HIDE IT
Explanation: You could tell this guy you drive a blue car and he'd find a way to twist it into something racial.
Juror #3 voted to HIDE IT
Explanation: Yeah, the racist association is too much.
Juror #4 voted to HIDE IT
Explanation: No explanation given
Juror #5 voted to LEAVE IT ALONE
Explanation: This is not over the top.
Juror #6 voted to HIDE IT
Explanation: As the song says in Frozen--Let It Go. Will's comments are nothing on par with those other two assholes.
Juror #7 voted to LEAVE IT ALONE
Explanation: If you're going to alert, bone up on your reading skills. He did not call WP a racist, nor did he say WP told watermelon jokes.
Left a mark.

(7,908 posts)eagerly awaiting your return to GD.
Thanks for taking the time to fill me in. (FWIW, I don't think your post should have been hidden.)
I wonder if Juror #2 remembers that no less a Dem stalwart than Bill Clinton called slavery 'America's original sin.' I wonder if he would dare to say what he wrote to President Clinton. Oh well.

There are a few folks at DU that really hate black people. WE know it. And it's not breaking TOS to share that. So what's happened is these really rotten sneaky little bigots who snuck into DU -off the radar - took the opportunity to knock 1strong.
It's best to hide comments like this within subthreads because if not some little snot alerts because their feelings got hurt. A Black folk stepped out of line.
Yeah - I'm really pissed about 1strong's hide.
