Justice Department: No Criminal Referral Over Clinton Emails

Updated | The Justice Department said Friday it has received a request to examine the handling of classified information related to private emails from Hillary Clinton during her time as secretary of state, but it is not a criminal referral.
The department's statement followed a report by The New York Times that Justice Department officials had received a request to open a criminal investigation into the Clinton emails. A separate memo from government inspector generals that was disclosed Friday expressed concern about how the emails were being handled as they were prepared for release to the public.
On Thursday evening, the Times reported that the Justice Department was weighing a request by two government inspectors general to open a criminal investigation into whether sensitive government information was mishandled in connection with Clinton's use of a private email account for her work as secretary of state. The Times report initially suggested that the inspectors general, who were not identified, had asked the Justice Department to decide whether Clinton mishandled classified information while serving as secretary of state, but the article was later adjusted to suggest the invesitgation would focus only on whether information was mishandled in connection with her private account. As of Friday afternoon, the Times was categorizing the request as one for a criminal investigation.
Clinton has repeatedly said she broke no laws or rules by eschewing a standard government email account for her State Department work in favor of a private account linked to a computer server in her New York home. She has also said she sent no classified information through email.
Her exclusive use of a private email account first came to public attention in March, opening her to a volley of criticism from political opponents as she began her presidential campaign that she was sidestepping transparency and record-keeping laws.

Lawyers with the Justice Department on Thursday told a federal court that Hillary Clinton had the legal right to use her own email account and broke no laws in how she handled those messages, The Washington Times is reporting.
The lawyers defended the former secretary of state in a legal filing, saying they have no right to order Clinton to turn over any more emails or documents than those she has already given back to the government.
"There is no question that Secretary Clinton had authority to delete personal emails without agency supervision she appropriately could have done so even if she were working on a government server," the DOJ lawyers said, according to the Times. "Under policies issued by both the National Archives and Records Administration (NARA) and the State Department, individual officers and employees are permitted and expected to exercise judgment to determine what constitutes a federal record."
Clinton used her private email account and home server in lieu of the official government email system while she served as top diplomat from 2009 to 2013.
Judicial Watch, which has filed several law suits and records requests regarding Clinton's emails said the administration is ignoring its own rules............................................................

Reality has bitten Republicans in the backsides again as the Justice Department is saying that Hillary Clintons emails broke no laws.
Justice Department lawyers argued before a federal court that Hillary Clintons handling of her emails broke no laws.
The Washington Times reported:
In the most complete legal defense of Mrs. Clinton, Justice Department lawyers insisted they not only have no obligation, but no power, to go back and demand the former top diplomat turn over any documents she hasnt already given and neither, they said, can the court order that.
The defense came as part of a legal filing telling a judge why the administration shouldnt be required to order Mrs. Clinton and her top aides to preserve all of their emails.

And I am willing to give the DoJ the time they need... but you should send this precise OP to the FBI director and tell him why Newsweek is saying no charges.
