Amendment 1 could also have troubling implications for straight couples. Thanks to the law's vague wording, critics argue it would likely strip away many of the legal rights associated with domestic partnerships or legal unions.

This is because Amendment 1 says "Marriage between one man and one woman is the only domestic legal union that shall be valid or recognized in this State." While it's being called a gay marriage ban, the amendment is more than that—it's an all-out refusal to recognize any kind of partnership or union that isn't marriage. So gay North Carolinians, who couldn't get married anyway, are screwed, and so are straight, unmarried North Carolina couples.

Unfortunately, activists in favor of the amendment kept saying that it wasn't true because people can still do "private contracts." People don't understand that it's not that simple.

A will is effective, but not necessarily applied right after a death.

A power of attorney is effective, but you better keep it with you at all times.

Family gets first dibs regarding child custody. If somebody isn't legally the child's family, then it really doesn't matter if a parent wants to do a "private contract."

Companies can pool to pay for the insurance of unmarried domestic partners, but they'll be paying full price. Most companies won't be able to do this.

This has messed people up badly.
