WASHINGTON — Experts in government secrecy law see almost no possibility of criminal action against Hillary Clinton or her top aides in connection with now-classified information sent over unsecure email while she was secretary of state, based on the public evidence thus far.

Some Republicans, including leading GOP presidential candidate Donald Trump, have called Clinton's actions criminal and compared her situation to that of David Petraeus, the former CIA director who was prosecuted for giving top secret information to his paramour. Others have cited the case of another past CIA chief, John Deutch, who took highly classified material home.

But in both of those cases, no one disputed that the information was highly classified and in many cases top secret. Petraeus pleaded guilty to a misdemeanor; Deutch was pardoned by President Bill Clinton.

By contrast, there is no evidence of emails stored in Hillary Clinton's private server bearing classified markings. State Department officials say they don't believe that emails she sent or received included material classified at the time. And even if other government officials dispute that assertion, it is extremely difficult to prove anyone knowingly mishandled secrets.

"How can you be on notice if there are no markings?" said Leslie McAdoo, a lawyer who frequently handles security-clearance cases.........

No one accused BS of breaking the law in respect of his campaign contributions - and yet some found it exceedingly important to point out that he hadn't done what no one ever accused him of doing.

The only "spin" here is you not knowing that those emails weren't classified as confidential at the time, and trying to change the subject as a result thereof.

She should have known the info was classified. Like I said, her poor judgment and worse management and leadership will dog her for months.

Luckily, there is time for Dems to correct this mistake before it happens.

I don't think Clinton did anything criminal, and I really think the whole "scandal" is a tempest in a teapot, but the mere fact that a document is not marked as classified doesn't mean that there is no way to know that it is classified.

... think it important to publicize the fact that she's not guilty of the "crimes" that some DUers (all good Democrats, I'm sure) have been accusing her of.

Just yesterday, some BS supporters thought it was a "selling point" that Bernie hadn't broken campaign finance laws by accepting a donation that was above the legal limit - even though no one had ever suggested that he did, or would.

It just made for a nice human interest story, down to earth, not in the Hamptons, regular person story.

We like that kind of person. He doesn't need "selling points", he's not for sale.

Breaking the law as a measurement is not dealing with the primary issue that started the whole set of email messes, and that was the screwed up decision SHE made to move her mail to a private server and still hasn't explained why she did so effectively. The price of having many people being suspicious of her breaking the law with that move is completely on her, whether she broke the law with that mail or not.
