Sanders calls for federal probe of Exxon

Sanders calls for federal probe of Exxon

By Timothy Cama - 10/20/15 04:25 PM EDT

Sen. Bernie Sanders (I-Vt.) is asking the Justice Department to investigate whether ExxonMobil Corp.’s climate change research strategy broke federal law.

The Democratic presidential candidate cited a recent investigation by InsideClimate News that found that Exxon, prior to its merger with Mobil, concluded from its research in the 1970s that climate change is a real threat but later spent millions of dollars sowing doubt about global warming.

Sanders asked Attorney General Loretta Lynch to determine whether the oil giant’s actions were illegal.
“These reports, if true, raise serious allegations of a misinformation campaign that may have caused public harm similar to the tobacco industry’s actions — conduct that led to federal racketeering convictions,” Sanders wrote in the Tuesday letter.

“Based on available public information, it appears that Exxon knew its product was causing harm to the public, and has spent millions of dollars to obfuscate the facts in the public discourse,” he said. “The information that has come to light about Exxon’s past activities raises potentially serious concerns that should be investigated.”..

9. While I support Bernie, I'm not sure the tobacco case model is one to follow

What is needed is a serious, forward looking attack on the environmentally unfriendly practices engaged in by major energy companies. But the RICO case brought against the tobacco industry was, ultimately, a more symbolic victory than a substantive one.

First, the RICO suit was a civil suit, not a criminal complaint (and thus the "convictions" referred to were really just civil judgments). There were no monetary damages, the appeals court having ruled out that form of relief. What the court ended up doing, six years after the complaint was filed, was to issue at 1700 page decision that spelled out all the bad things the tobacco industry had done in terms of misleading the public about the harmful impact of smoking and then order them not to do it anymore. Which didn't really mean much, since by 2006 pretty much everyone knew that smoking was harmful.

Second, the court did order the tobacco companies to engage in a messaging campaign regarding the harmful effects of smoking. That part of the order is still being litigated today, more than 16 years and the expenditure of millions of dollars in legal costs by the government. And its not as if the tobacco companies aren't already obligated to publish anti-smoking messages.

When the tobacco case was brought in 1999 I thought it was a great idea. But having seen what it produced (and what it could have produced given the limitations of the law), I don't think going down that route again is that great an idea. There are better, and more aggressive steps that the government should be taking (and that Bernie undoubtedly would support) to address current energy company behavior that harms the environment rather than their past efforts to cloud the issue.

He's not afraid to go after the source of the problems. He can go after Exxon because he's not beholden to them.

What Exxon did was basically a crime against humanity (and every other living thing on this planet).

I haven't bought Exxon since the Valdez ran ashore. They are the true epitome of an evil conglomerate.

Martin O'Malley ‏@MartinOMalley Oct 16

We held tobacco companies responsible for lying about cancer. Let’s do the same for oil companies & climate change. http://omly.us/1RfPi0U

from his climate change plan months ago:

"End all subsidies for fossil fuels, while extending production and investment tax credits for renewable energy for the long term. Taxpayer subsidies for fossil fuel companies total $4 billion a year, even as the biggest oil companies reap $90 billion in annual profits"

O'Malley has been a step ahead on the issues the entire campaign.
