Victims Push Laws to End Online Revenge Posts

...

Revenge porn sites feature explicit photos posted by ex-boyfriends, ex-husbands and ex-lovers, often accompanied by disparaging descriptions and identifying details, like where the women live and work, as well as links to their Facebook pages. The sites, which are proliferating, are largely immune to criminal pursuit. But that may be changing. California lawmakers this month passed the first law aimed at revenge porn sites.

With cellphone cameras ubiquitous and many Americans giving in to the urge to document even the most intimate aspects of their lives, revenge porn has opened up new ways to wreak vengeance.

...

“It has been watered down again and again as it has weaved its way through Sacramento,” said Charlotte Laws, who began pushing for legislation after pictures of her daughter, Kayla, 26, were posted on a site.

“What we really need is federal legislation,” Ms. Laws said.
...

Professor Franks said that opposition to legislation often stems from a blame-the-victim attitude that holds women responsible for allowing photographs to be taken in the first place, an attitude similar in her view to blaming rape victims for what they wear or where they walk.

2. I think there are laws on the books that can be used to prosecute

Or at least sue...

Defamation, libel and slander laws should be taken into account, rather than writing new laws

3. I agree with the legal scholars who think criminal penalties are needed.

A federal law with criminal penalties.

Obviously the existing laws re: libel and defamation are useless.

4. Useless for criminal penalties, yes

But I think they could sue for defamation, and win...

A new law making defamation a criminal act - be careful with that

The law of unintended consequences lurks behind every corner

5. Why are you singling out defamation?

Invasion of privacy was mentioned in the article so that's probably the most likely option.

6. Because I don't know if invasion of privacy would cover this

And I think defamation would result in more successful trials

Since our goal is to get angry exes to stop posting pics on revenge sites, the threat of a huge fine should be enough to make posters think twice

Being that the pictures were willingly sent to the ex- - I don't think invasion of privacy would cover it

It's bullshit behavior and has the potential to create specific vulnerability in a number of areas; that should be actionable.

LOL, just kidding! I know very well why... getting a woman's consent before doing just about anything is more of a quaint expectation than anything else. We exist in a perpetual state of yes. That has to change.

Just like it doesn't matter if a rape victim has been drinking or was drunk.

That kind of stuff is used to portray some women as being more deserving of having their consent disregarded... it's a game we're better off not playing along with.

Same dynamic is also involved with making excuses for having abortions (e.g. hydroencephaly). There's no excuse needed other than the woman in question does not want to be pregnant.

are a lot of pictures that are going up, the gf or wife didnt even know about then what should be stated also

putting damn pictures on the net without consent will result in jail time!

that simple.

without discussion of, even thought of a gf or wife gave the picture.

see what i mean

cause it has to be known that we are now living in a world that living in a same house, with a partner can result in unwanted pictures that end up on the net as much as trusting a partner with a pic

THAT is a womans world today.

you know, go into a fuckin gyno for the health of our body and the creepy, dickless pervert takes pictures and puts it on the net. THAT world.

there should be NO qualifying at all.
