The Second Amendment Has Nothing to Do with Gun Ownership
Retired Chief Justice Warren Burger, "The Right to Bear Arms," Parade Magazine, January 14, 1990.
In 2008, this fraud was furthered by Mr. Scalia, joined by his fellow ideologues Thomas, Alito, Roberts and Kennedy. Yet five zealots in black robes cannot change the historical record. Writing something down on paper or pushing the send button to the internet doesn't make it so. Scalia and gang, in ganging together to pen District of Columbia v. Heller, cannot change history, anymore than a Truther diary about how the 9-11 hijackers were Republican ideologues giving their lives for Bush and Cheney, makes such idiocy so.
In its 2002 decision Silveira v. Lockyer, the Ninth Circuit Court of Appeals provided a very detailed, extensive, and well researched examination of the historical record surrounding the adoption of the Second Amendment. Although Silveira v. Lockyer would overturned by Messrs. Scalia, Thomas, Roberts, Alito and Kennedy in 2008, the 9th Circuit's outstanding research surpasses both Scalia's NRA talking points that passes for a Supreme Court decision, as well as Justice Stevens' far more persuasive dissent. This diary provides a summary of the Ninth Circuit's research that led to that court's conclusion that the Second Amendment was intended to protect the right of the states to form militias, and was not intended to allow anyone and everyone without restriction to buy whatever guns may be on the market. I hope, in a future diary, to analyze Scalia's Heller opinion and illustrate why Scalia is wrong and a hypocrite to claim that he is governed by original intent.
The Second Amendment states:
A well regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
"he original intent of the Second Amendment was to protect the right of the states to form and maintain state militias"

State Militias = National Guard!
Well regulated could be restrictions on certain types of weapons.
Fiscal cliff failure looks likely due to Boehner's House 'dictatorship'
By Michael O'Brien, NBC News
The Senates top Democrat said Thursday that he was pessimistic that Washington could avoid the impending fiscal cliff, accusing House Speaker John Boehner, R-Ohio, of running the lower chamber as a dictatorship.
Senate Majority Leader Harry Reid, D-Nev., said he was unsure there was enough time between now and the end of the year to reach a deal to avoid the combination of spending cuts and tax hikes set to take effect on Jan. 1. Reid said the only viable escape route was for the GOP-controlled House to give its approval to a Senate bill that would preserve existing tax rates on income under $250,000.
Everyone knows that if they had brought up the Senate-passed bill, it would pass overwhelmingly. But the speaker says, no we can't do that, Reid said on the Senate floor this morning. It's [the House] being operated by a dictatorship of the speaker.
In response, a spokesman for Boehner said in a statement, "Senator Reid should talk less and legislate more. The House has already passed legislation to avoid the entire fiscal cliff. Senate Democrats have not."

Proposal for gun safety...
We create a national arms database we can call it NADs
Every firearm manufactured or imported would be registered in the database, manufacture, manufacture data, seller, sold date, owner(s).
The database would identify what type of weapon it is, and where it is located, how it is stored (locked in gun case, hung in the back window, set in the corner of the dining room).
As well, every piece of ammunition would likewise be registered, where made, sold, owner, expended.
Owners would be required to report an inventory either on line or through a mail in survey for the really back woods rednecks. This could be an annual task or whenever there is a transaction or ammunition use.
Freedom ain't free and citizenship requires some responsibility! The gun owners need to man up and take responsibility for their right to bear arms.
Our automobiles are in a database, we have to keep that information current and take responsibility for our automobiles, so why not guns?
End-of-world rumors prompt Michigan officials to close 33 schools
Michigan education jumps the shark:
Matt Wandrie, superintendent for Lapeer Community Schools, said doomsday "rumors" are running rampant in several districts, adding to fears raised by last week's school shooting in Newtown, Conn.
"Given the recent events in Connecticut, there have been numerous rumors circulating in our district, and in neighboring districts, about potential threats of violence against students," Wandrie wrote on his website.
"Additionally, rumors connected to the Mayan calendar predicted end of the world on Friday have also surfaced," he added.

For us future retirees, Social Security will only be coffee money.
It will not be a the safety net we expected.
We have paid into this program for 40 or more years and the rich fuckers need it worse than we do.
