No state voted more heavily for the GOP presidential nominee in 2012 than Utah. And in 2008, it was the third-most Republican state in the union.
A new poll shows that Donald Trump is tied with Hillary Clinton in Utah.
We're not quite saying, of course, that Utah is a tossup or that Trump is in real trouble in the ruby-red state — or even that it portends trouble for Trump in the 2016 presidential race, more broadly. There are plenty of factors at work here that are unique to Utah and the poll (which we will get to).
But it's also hard to overemphasize how unthinkable it is for a Republican — any Republican — to be tied in Utah in any poll.

Why Obama Had to Waive HIPAA in Orlando

So it is perhaps especially poignant that, in the aftermath of the deadliest shooting to date on American soil, at a gay nightclub in Orlando, Florida, the White House applied a unique waiver to HIPAA. In declaring the situation in Orlando a national emergency, President Barack Obama and Secretary of Health and Human Services Sylvia Mathews Burwell made it easier for family and friends to gain quicker access to information—the right move in such a circumstance.
That’s because the individual patient is not the only stakeholder when it comes to health information. In fact, HIPAA was specifically written to ensure public well-being—something that becomes very relevant in cases of emergency, when panicked people are waiting in a hospital for critical news. While the original law does allow physicians to share information with a patient’s family, friends, or other health care providers if a “reasonable inference” could be made based on the circumstances, this is generally approached with great caution and most doctors err on the side of maintaining silence. Which is why it’s so critical that Obama was able to invoke a revision of the Social Security Act (Section 1135), which was enacted after the Sept. 11 attacks, and explicitly authorizes health care providers broad exemptions from the normal privacy safeguards relating to sharing a patient’s protected health information—especially with friends and loved ones in the event of an emergency.
Section 1135 waivers are both narrow and brief in their application. The waivers apply only to an “emergency area” and only during an “emergency period,” which in most circumstances should last no longer than 72 hours. In order for a waiver to be granted, two conditions must be met: the president must declare a “National Emergency” and the secretary of the Department of Health and Human Services must declare a public health emergency. Only when these conditions co-exist may a waiver legally be authorized.
The waiver does not suspend HIPAA entirely. Far from it: In fact, Section 1135 waivers limit a very finite number of exceptions to the HIPAA law. Specifically, the waivers protect health care providers from the usual sanctions and penalties that might be levied against them as a result of noncompliance with HIPAA privacy regulations. The most relevant carve-outs certainly pertain to the situation in Orlando, where there are reports of numerous families asking for providers at the receiving hospital to release health information about their loved ones. Such information would normally be HIPAA–protected, but verifying a patient’s consent to speak with family members or friends about that patient’s condition is often impossible, or impractical, after a mass shooting. And it would be cruel to deny families such information.
It is remarkable that, to my knowledge, a Section 1135 waiver has only been granted once before, during the rescue operations after Hurricane Katrina. Frankly, that’s likely due to the fact that the law is simply not that old. Sadly, though, it appears its use has become more relevant and, until we move to keep assault rifles out of the wrong hands, is likely to be invoked again in the future.

It was promoted as the chance of a lifetime: Mom-and-pop investors could buy shares in celebrity businessman Donald Trump’s first public company, Trump Hotels and Casino Resorts.
Their investments were quickly depleted. The company known by Trump’s initials, DJT, crumbled into a penny stock and filed for bankruptcy after less than a decade, costing shareholders millions of dollars, even as other casino companies soared.
In its short life, Trump the company greatly enriched Trump the businessman, paying to have his personal jet piloted and buying heaps of Trump-brand merchandise. Despite losing money every year under Trump’s leadership, the company paid Trump handsomely, including a $5 million bonus in the year the company’s stock plummeted 70 percent.
Many of those who lost money were Main Street shareholders who believed in the Trump brand, such as Sebastian Pignatello, a retired private investor in Queens. By the time of the 2004 bankruptcy, Pignatello’s 150,000 shares were worth pennies on the dollar.
“He had been pillaging the company all along,” said Pignatello, who joined shareholders in a lawsuit against Trump that has since been settled. “Even his business allies, they were all fair game. He has no qualms about screwing anybody. That’s what he does.”

As the company spiraled downward, it continued to pay for Trump’s luxuries. Between 1998 and 2005, it spent more than $6 million to “entertain high-end customers” on Trump’s plane and golf courses and about $2 million to maintain his personal jet and have it piloted, a Post analysis of company filings shows.

The New York Times is out with an extensive report about Donald Trump's 25 years of business dealings in Atlantic City, dealings which the presidential candidate has cited as his golden era in the casino business, as well as one of the prime examples of his business (and free-world leadership) acumen, insisting that he is “very proud” of the enormous amount of money he made in the city. In fact, according to the Times report, the real estate mogul simply leveraged his name and reputation to promise greatness, but instead delivered financial catastrophe onto almost everyone involved but himself:
His audacious personality and opulent properties brought attention — and countless players — to Atlantic City as it sought to overtake Las Vegas as the country’s gambling capital. But a close examination of regulatory reviews, court records and security filings by The New York Times leaves little doubt that Mr. Trump’s casino business was a protracted failure. Though he now says his casinos were overtaken by the same tidal wave that eventually slammed this seaside city’s gambling industry, in reality he was failing in Atlantic City long before Atlantic City itself was failing.
The Times adds that Trump's businesses seemed set up to fail, because he “assembled his casino empire by borrowing money at such high interest rates — after telling regulators he would not — that the businesses had almost no chance to succeed.” They also found that a component of one of the million-dollar transactions which benefitted Trump — when he sold his shares of the Riviera Hotel and Casino in 2004 — may have even been illegal, though it was never investigated by authorities.
Looking at the deals and aftermath en masse, Trump's profitable failures do indeed demonstrate his business prowess — provided that is the business of making himself rich at the expense of others.
