The Profiting off of Michael Brown's Death, and Other Disgusting Actions in Ferguson

"Somehow, the REAL story has been lost.

The story was about how a young man was murdered in cold blood on an Saturday afternoon in August, which hundreds of neighbors witnessed the man's body in the streets for hours on end, or a few -- the murder itself.

The Victims' name is Michael Brown.

As of Thursday August 21, 2014, Victim Brown has not yet received a burial service by his loved ones. The family were waiting on the results of two autopsy reports after Brown's shooting death. Brown's survivors have scheduled a home-going and burial service on Monday, August 25.

Still, never fear, the profiteers and attention seeking vultures have entered Ferguson. Attempting, and sadly receiving periled vision measures of success, by driving attention to themselves instead of directly towards the tragedy of Brown's murder.

Whether its' T-Shirts, Face-time in front of a camera, morphing into a "national celebrity" while someone manages a twitter account, voter registration drives, racists rising up to throw fire on frames of ethnic hate or journalists becoming the story; the death of a 18-year-old young man."

Dr. Michael Baden Autopsy Evidence on why Thomas Jackson Must Go, Darren Wilson Must Be Arrested..

(Dr. Michael Baden)

"Baden, who also spoke at the news conference, said Brown, 18, was shot at least six times, including twice in the head. None of the bullets entered from the back, and three were recovered from Brown's body, he said.

Brown could have survived all of his wounds except for the shot to the top of his head, Baden said. That shot was probably sustained last, hitting Brown as he was bending over, and exited through his right eye, he said.

Baden said Brown was shot from at least one foot away but the distance could have been as far as 30 feet. Baden said six bullets entered Brown's body and at least two bullets ricocheted and traveled back through his body. Bullet wounds to Brown's arms could have been sustained by putting his hands up or crossing his arms."

http://www.usatoday.com/story/news/nation/2014/08/17/justice-department-autopsy-brown-ferguson/14196559/

"One bullet entered the top of his head and another entered directly above his right eyebrow. Mr Brown was 6ft 4in (1.9m) tall.

"All of the gunshot wounds could have been survivable, except the one at the top of the head," Dr Baden said."

http://www.bbc.com/news/world-us-canada-28839522

"Dr Baden said there were no signs of a struggle, as abrasions around the teenager's face were likely from falling to the pavement after being shot.

He also believed Mr Wilson did not shoot him at close range as there was no gunpowder residue on his body, suggesting the officer was at least 2ft away."

http://www.bbc.com/news/world-us-canada-28839522

All wounds were SURVIVABLE except the ones to the head. In other words, Michael Brown could have survived if a SHOOT to STOP instead of SHOOT to KILL strategy was deployed by Ferguson Police Officer Darren Wilson, who is still running free.

Furthermore, Dr. Michael Baden statements prove that Ferguson Police Chief Thomas Jackson LIED in his presser last week (the first one) where he stated Wilson "struggled" with Brown.

With such, THOMAS JACKSON MUST GO and killer Ferguson Police Officer DARREN WILSON MUST BE ARRESTED NOW for the Murder of Michael Brown. Our original post on DU calling for Chief Jackson's immediate resignation is here:

Ferguson, MO Police Chief THOMAS JACKSON Must Resign NOW! This is why....

UPDATE - August 18, 2014: Our Op/Ed on why Ferguson Thomas Jackson Must Resign has been RT'ed by NYT Columnist Charles Blow after Brown's Family Pathologist Dr. Michael Baden's report.

The Tweet is here and the link is to the article. Please reshare the article, if preferred:

@CharlesMBlow "No Evidence of a Struggle," Says Dr. Michael Baden should renew calls NOW for #THOMASJACKSONMUSTGO http://j.mp/JacksonMustGo1 - @IUNewsTalk
-------------------------------------------------------------------------------------------------------------------------------------------------

It is a Robbery that is allegedly shown in the still pictures and the video. The video has been released on MSNBC and the entire incident was less than 45 sections.

The Suspect appears in the video attempt to walk out of a store holding the alleged cigarillo's stolen in hand.

The alleged Victim runs in front of the door of the store, allegedly to stop the Suspect from leaving the location with the alleged cigarillo's stolen.

The Suspect pushes the alleged Victim out of the exit door of the store, near a store rack, and immediately let's go of the Victim in less than 10 sections.

The Suspect proceed to walk out of the door with another individual.

The Victim begins to re-approach the Suspect again.

The Suspect turns to the left to re-approach the Victim, however does not re-confront the Victim in any assaultive way. Words are exchanged.

The Suspect turns back to the right towards the store door and walks out of the door with the alleged Cigarillo's, with another individual.

The Victim approaches the door and appears to be yelling out of the door, while holding the door.

The Suspect is not seen again in the video at this point.

NOW....since that is out of the way, the force used by Law Enforcement Official DARREN WILSON in response to this alleged Robbery was excessive! To shoot an Alleged Suspect in a alleged Robbery 8-10 Times in the streets like a DOG for allegedly pushing a store clerk after allegedly stealing Cigarillo's, this action DOES NOT fit the nature of the alleged crime!

Officer DARREN WILSON should be charged with Murder in the First Degree and Police Chief Thomas Jackson MUST RESIGN from the Ferguson Police Department for failing to train his staff in proper procedures in engaging criminal suspects, along with failing to instruct his staff to call for BACK-UP as a MANDATORY ACTION for engaging a suspect in an alleged robbery WITHOUT a WEAPON.

The Force Used DOES NOT FIT the ALLEGED CRIME. In addition, Ferguson Police Chief THOMAS JACKSON must be FORCED to RESIGN for TAINTING the investigation of the KILLING of Mike Brown!

So Let Us Get This Correct.....

The Ferguson Police Department and particularity Police Chief THOMAS JACKSON is trying to "Justify" the shooting of teenager Mike Brown 8-10 times, to stealing 8 Cigarillo's in a store 30 minutes earlier.

So stealing Cigarillo's to Police Chief THOMAS JACKSON and the murdering cop DARREN WILSON means the person should be SHOT 8-10 times in the middle of a PUBLIC STREET in DAYLIGHT, like a DOG.

Really now? Please spread the FERGUSON POLICE DEPARTMENT SHAME in Justifying the EXECUTING of a African-American teenager for stealing allegedly cigarillo's.

Gov. Rick Snyder compares flooding of a Lake House to S.E. MI Residents Impacted by Tuesday Storms

Here we go AGAIN.....

"As exclusively reported on IUNT December 30, 2013 or four days after Christmas, Michigan Governor Rick Snyder was tardy in response to Mid-Michigan residents last Winter experiencing severe power outages during an massive ice storm.

It would appear Gov. Snyder, vying for re-election on November 4, has yet to change an overall dismissive response to Michigan residents in midst of temporary crisis.

This time the residents are in S.E. Michigan. Detroit, Warren, Michigan and other surrounding communities adjacent to the heavily traveled expressways of I-75 and I-696 continue to dig out from massive rain storms flooding streets, basements and businesses."

Michigan Voters Lack of Information on Proposal 1 of 2014, Leads Pending Language Clarity Lawsuit...

Do we, the public-at-large vote on issues without having all the complete information to do so? Is our main steam media complicit in holding back facts we need to know at times of importance? Does the low voting turnout during Michigan's August 5, 2014 primary means a similar low voter participation rate for November 4, 2014 General Election?

Part 1 -The answer to all of the above questions is yes:

"Michigan's Supreme Court on July 14 majority opinion decision on International Business Machines (IBM) Corporation v Department Of Treasury, case docket 14644, will have large implications for the state budget going forward.

As it stands right now, the state of Michigan is on the hook to IBM and likely 147 other corporations filing legal briefs in this case, for upward to $1.1 Billion dollars or more.

Writing for the majority, Justice David Viviano stated:

"It is a well-established rule that in the construction of a particular statute, or in the interpretation of its provisions, all statutes relating to the same subject, or having the same general purpose, should be read in connection with it, as together constituting one law, although they were enacted at different times, and contain no reference to one another.

The endeavor should be made, by tracing the history of legislation on the subject, to ascertain the by tracing the history of legislation on the subject, to ascertain the uniform and consistent purpose of the legislature or to discover how the policy of the legislature with reference to the or subject-matter has been changed or modified from time to time.

In other words, in determining the meaning of a particular statute, resort may be had to the established policy of the legislature as disclosed by a general course of legislation. With this purpose in view therefore it is proper to consider, not only acts passed at the same session of the legislature, but also acts passed at prior and subsequent sessions," Id. at 543-544 quoted."

Simply put, before a legislative body enacts a law, the Representatives are expected to perform due diligence. Ensuring outstanding questions related prior statutes similar in nature, are addressed in the new legislation.

At play in the Michigan Supreme Court July 14 decision is Michigan Business Tax (MBT) from 2007, the Multistate Compact Tax Statute from 1969, and a Business Tax cut for C & S Corporations in HB 4361 of 2011.

Michigan Multistate Tax Compact of 1969 purpose was to “proper determination of state and local tax liability of multistate taxpayers, including the equitable apportionment of tax bases and settlement of apportionment disputes.” In this case businesses operating in Michigan, whose headquarters or primary physical location is not located in state, would be subject to state and local taxation rates on revenue made, in Michigan."

Ruling in corporate tax case could cost Michigan $1 billion

Source: Detroit Free Press

In a strongly worded post-opinion motion seeking a rehearing of the case, Attorney General Bill Schuette said the ruling “results in the state potentially owing a budget-busting aggregated tax refund in the hundreds of millions of dollars (not including interest) to mostly out of state corporations.

“The total cost to the state is likely to exceed $1 billion,” Schuette said.

In a separate motion asking the court to stay its July 14 ruling “as to all lower court cases,” Schuette said there are 134 similar cases filed by out-of-state corporations pending in Michigan courts and “there are thousands of potential claims.”

"Kurt Weiss, a spokesman for the Michigan Department of Technology, Management and Budget, said officials believe most of the impact would be felt in the 2014-15 fiscal year, though there could also be some impact this year.

“It creates a significant problem for the budget,” Weiss said. “We are hoping for reconsideration from the Supreme Court.”

It’s exceedingly rare for the Michigan Supreme Court to reverse one of its own opinions in a rehearing.

And an appeal to the federal courts does not appear to be an option, said Dave Murray, a spokesman for Gov. Rick Snyder.

Justice David Viviano wrote the majority opinion in favor of IBM, joined by Justices Michael Cavanagh and Stephen Markman, and by Justice Brian Zahra, who wrote a separate concurring opinion. Justice Bridget McCormack wrote the dissent, siding with the Treasury Department, joined by Chief Justice Robert Young Jr. and Justice Mary Beth Kelly.

At the heart of the cases are state corporate income tax policies designed to favor local corporations at the expense of out-of-state corporations, Hamilton said. The Michigan Business Tax, which was repealed in 2011, required out-of-state corporations to calculate their taxes based on sales, she said."

And there more:

But since 1970, Michigan has belonged to a multistate compact, intended to make things easier for out-of-state corporations by providing greater uniformity in how they calculate their tax bills for various states. Under the compact, corporations have the option of using the state tax law or an optional formula that considers not just sales but the property and payroll a corporation has in a given state.

Weighing in those factors generally leads to lower income tax bills for out-of-state corporations, Hamilton said. And companies such as IBM went to court to argue they could still use that method, despite what the MBT said.

The Michigan Court of Claims sided with the Michigan Treasury Department, as did the Michigan Court of Appeals.

But the Michigan Supreme Court has ruled for IBM, rejecting the state’s arguments that Michigan implicitly repealed the alternative tax calculating option set out in the compact when it passed the MBT — even if it didn’t explicitly do so.

The Legislature “had full knowledge of the compact and its provisions” when it passed the MBT, yet it “left the compact’s election provision intact.”

In fact, the court suggested the Legislature shot itself in the foot in 2011, when it amended the legislation related to the multistate compact to say that starting Jan. 1, 2011, out-of-state corporations no longer had the option of using the three-pronged method to calculate state taxes.

If the Legislature hadn’t wanted corporations to use that method in 2008, 2009 or 2010, it would have made the 2011 statute fully retroactive, the court said.

And some Michiganders were FOOLED into voting for Proposal 1 of 2014, cutting the Business Tax on Equipment just on Tuesday. What a joke on them, this is.

Oh yea, the Media just let out details on this important case which have been in the Michigan Court System for a minute now, this morning....
