Restaurant chain Sizzler files for Chapter 11 bankruptcy, citing impact of COVID-19 pandemic

Sizzler, the famous steakhouse started 62 years ago, has filed for Chapter 11 bankruptcy protection, the latest business to suffer as a result of the COVID-19 pandemic.

In a statement, Sizzler said it filed for voluntary Chapter 11 protection in the U.S. Bankruptcy Court for the Northern District in California on Monday.

The restaurant chain will start a restructuring process to reduce debt and renegotiate its leases with landlords.

"Our current financial state is a direct consequence of the pandemic’s economic impact due to long-term indoor dining closures and landlords’ refusal to provide necessary rent abatements," said Chris Perkins, president and chief services officer for Sizzler, in a statement.

Commercial real estate flounders as housing market booms

The housing market is red hot thanks to record-low mortgage rates and consumers looking to flee cities for the suburbs. But offices, shopping malls and other commercial real estate properties have been hit hard by the coronavirus pandemic.

The rise of Zoom (ZM), Slack (WORK) and other productivity tools has made it easier for people to set up home offices and still get their jobs done. Meanwhile, Amazon (AMZN) and other digital retailers are flourishing amid the Covid-19 pandemic as the shift from bricks to clicks has accelerated.
"There will likely be less demand for commercial real estate due to the rising popularity of online shopping and working from home," said Ivy Investments global economist Derek Hamilton in an e-mail.
That's why giant corporate real estate firm Brookfield Property Partners (BPY) said it will lay off 20% of the 2,000 employees in its retail arm, which owns malls and other shopping centers that include Tysons Galleria in Virginia and the Grand Canal Shoppes at The Venetian Resort Las Vegas.

Amy Coney Barrett fought to undermine health care for millions in her attack on the Affordable Care Act, and publicly criticized Chief Justice John Roberts for his decision to uphold the law. She also fought efforts to ensure that all women have access to contraceptives. Barrett has been critical of Roe v. Wade, stating that the framework of Roe essentially permitted abortion on demand.

As a judge, Barrett sided against an African American worker who had been transferred to another store because of a company’s policy of segregating their employees, finding that the company’s “separate-but-equal arrangement is permissible.” She also joined a ruling siding against the Army Corps of Engineers’ efforts to protect wetlands in Illinois under the Clean Water Act, and has ruled to dismiss claims by workers who were denied access to justice to uphold workers’ denial of benefits.

She also would have ignored the First Step Act’s lower mandatory minimum sentences in the case of Hector Uriarte, who had been unlawfully sentenced before the Act passed and was now being re-sentenced. The judges argued that the mere existence of a previous sentence—even one vacated due to legal error—meant the First Step Act should not apply. This interpretation would have resulted in a mandatory additional 25 years’ imprisonment for Uriarte.

Like other Trump nominees, she has shown an inclination to rule in favor of the rights of the wealthy and powerful over the rights of all. The Alliance for Justice strongly opposes the consideration of Barrett for a seat on the U.S. Supreme Court.

$20K of Acrylic Now Protects Jefferson's Headstone



A $20,000 acrylic case now protects Thomas Jefferson's original headstone on the University of Missouri campus, a response to vandalism to a Jefferson statue that is also on campus and graffiti written on the sidewalk during the summer making reference to Sally Hemings, a slave who gave birth to children fathered by the third president. The clear case was installed Saturday over the granite obelisk that was originally erected at Monticello in Virginia in 1833. It was replaced in 1883 and given to the University of Missouri. It's unclear why, though it was the first state university established in the territory of the Louisiana Purchase, which was made when Jefferson was president, and was established with the University of Virginia as a model. Jefferson’s original tombstone "was entrusted to the university and we have a responsibility to [ensure] that it is preserved appropriately," spokesman Christian Basi said.

Chancellor Mun Choi this summer refused to remove the Jefferson statue, prompting a student, Roman Leaphart, to begin a petition drive seeking removal of the monument to “a racist slave owner.” Choi said at the time that the university would move to put Jefferson's complex history into context. A task force that includes students, faculty, and others is working on that project toward a goal of making recommendations by the spring, Basi said. There are two relics associated with the grave marker, reports the AP. The obelisk holds a replica of a marble plaque with the inscription Jefferson wrote for his grave: “Here was buried Thomas Jefferson; Author of the Declaration of American Independence; of the Statute of Virginia for religious freedom; Father of the University of Virginia.”
